Ces procédures peuvent être une source de stress. L'Agence des droits fondamentaux de l'Union européenne (FRA) s'est penchée sur la question de savoir si les droits des enfants sont respectés dans le cadre de ces procédures. Les conclusions du travail de terrain réalisé par la FRA, qui repose sur des entretiens avec des professionnels ainsi qu'avec des enfants, révèlent qu'il reste encore beaucoup à faire pour que la justice soit mieux adaptée aux enfants dans l'Union européenne (UE). Bien que tous les États membres de l'UE se soient engagés à faire en sorte que l'intérêt supérieur de l'enfant soit la considération primordiale lors de toute action qui les concerne, ses droits à être entendu, informé, protégé et à la non-discrimination ne sont pas toujours respectés dans la pratique. C'est la raison qui a conduit l'UE à promouvoir les Lignes directrices sur une justice adaptée aux enfants qui ont été adoptées par le Conseil de l'Europe en 2010. Le but est d'aider les États membres à renforcer la protection des enfants dans leurs systèmes judiciaires respectifs et à accroître leur participation effective, en améliorant ainsi le fonctionnement de la justice.

Children's rights have gained greater global visibility through the almost universal ratification of the United Nations Convention on the Rights of the Child. Treaty bodies for other international and regional instruments, which cover the rights of "everyone", including children, are giving increasing attention to children's rights. In the same vein, human rights mechanisms, including regional ones such as the European Court of Human Rights, the European Committee of Social Rights and the Inter-American Commission and Court, have become more sensitive to children's rights. With this increasing visibility comes the recognition that children in every country of the world suffer widespread and often severe breaches of the full range of their rights - civil, political, economic, social and cultural. Even the Nobel Prize winning economist Milton Friedman (1962), among the most ardent liberal supporters of the laissez faire philosophy, recognized this "paternalistic" function of government. At the same time, the traditional view of children, that they are the property of the father (pater) or the parents, is under pressure (Zelizer, 1994; James & Prout, 1997; Archard 2004). Societies are at an intersection when it comes to how children are treated and how their rights are respected, which creates tensions in the traditional relationship between the family and the state. Children are a focus of government responsibility under certain state-defined norms relating to harm and need. And parents are sometimes constrained by the state from exercising their (familial or property) rights under state-defined criteria of harm and need"--
