Excerpt from A Treatise on the Law of Dower, Vol. 1 of 2 In the volume now submitted to the public, I have endeavored to collect, and arrange in a convenient form, the various rules and principles of the law establishing and regulating the Right of Dower. This subject occupies a prominent and important place in the American Law of Real Property. The right of dower was established in England more than seven hundred years ago. For centuries it was regarded there as a favorite of the law. It is not strange, therefore, especially when we consider the humane purpose it was intended to subserve, that the custom was transplanted here by the colonists, nor that, we should find in the early legislation of the country evidence of an intention on their part to make it one of the permanent institutions of the land. And it has become so. With two or three exceptions, the statutes of all the United States contain provisions securing to the widow her right of dower. In view of the general importance of the subject, and of the fact that it has necessarily given rise to many interesting legal questions, and numerous judicial decisions, in the several States, it is a matter of some surprise that, among all the legal publications issued from the press, no elementary work has heretofore appeared, professing to treat, in an extended form, upon the American Law of Dower.
