La capacidad es un tema de interés transversal en el derecho, está presente en todos sus ámbitos. Es un atributo que tiene todo sujeto a través del cual puede realizar actos que no le estén prohibidos. Desde el 2018, a través del Decreto Legislativo 1384, contamos con un nuevo tratamiento de la capacidad en el Código Civil que se adecúa a las directrices en pro de la autonomía y la plena capacidad jurídica de las personas con discapacidad, en concordancia con lo que dictamina la Convención Internacional de los Derechos de las Personas con Discapacidad. El régimen de sustitución de la voluntad de las personas incapaces es reemplazado por un modelo social a través de los apoyos y salvaguardias. Nos encontramos frente a un modelo inclusivo, democrático, de acuerdo con el respeto a los derechos humanos de todos los ciudadanos, (dignidad e igualdad), que parte del principio de que las personas con discapacidad tienen capacidad de ejercicio plena en igualdad de condiciones en todos y cada uno de los aspectos de su vida, y que reconoce su derecho a tomar sus propias decisiones así como el derecho a equivocarse.

This book examines the implications of Article 12 of the UN Convention on the Rights of Persons with Disabilities (CRPD), its resulting standard of protection for persons with disabilities and the way it is understood and implemented in its diverse signatory states. Its overarching theme is to assess the impact of CRPD Article 12 on the private law concept of legal capacity and its limitations, the significance of which carries over into the realm of penal law regulations. Its impact is analysed primarily from the legal point of view, but with due regard for its psychological and psychiatric ramifications. Recognising the importance of these disciplines is important when implementing CRPD Article 12 into domestic law, as they contribute to the determinants in creating a qualificatory legal framework for all, persons with disabilities in particular, to exercise their rights to legal capacity without let or hindrance. As active legal capacity is a notion rooted in and coming from private law, this forms the main research perspective. The first section discusses the foundational concepts constituting the CRPD Article 12 standard from domestic private law and international law perspectives. The work shows that the concepts adopted in private law interact with the protection of persons with disabilities as victims provided for in criminal law. In addition, where relevant, authors also look at public law institutions that are connected with the private law solutions. This edition of the Inter-American Yearbook on Human Rights, like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion and protection of human rights. It begins with the composition of the Commission and Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions and reports by the Commission and historic correspondences and decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the Velásquez Rodríguez case (Honduras).
