La integración en la sistemática del derecho administrativo de los cambios habidos en las tareas administrativas ha de hacerse mediante una serie de pasos intermedios, condicionados más por la imaginación y la plausibilidad que por rígidas deducciones dogmáticas. La construcción de un régimen de responsabilidad patrimonial del Estado en todo ordenamiento jurídico no ha sido, no es, ni será completada sin que pueda indagarse constantemente el alcance del instituto de la responsabilidad, de los valores que este representa en el actual modelo de Estado Social y Democrático de Derecho, y de la esencia que persigue la sociedad moderna donde dicha herramienta no puede quedar reducida a su vocación económica, sino que debe adaptarse a realidades dinámicas y complejas. En ese sentido, el tratamiento del primer e incuestionable elemento del instituto de la responsabilidad como es el daño enfrenta retos cruciales al momento de su definición, delimitación y comprensión. La comprensión del principio de precaución y su influencia en la determinación de los eventos en los que se produce un daño en escenarios de incertidumbre invita a considerar la amenaza- como un estadio que, sin desconocer la consumación o concreción material y antijurídica del daño, merece ser estudiada, valorada y discutida para determinar cómo puede influenciar el análisis en ámbitos como la prestación del servicio o actividad médica, el control, vigilancia y seguimiento de productos, bienes o servicios, o la producción de fenómenos contaminantes en las sociedades modernas, entre otros.

Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing.
