The governance of post-conflict territories embodies a central contradiction: how does one help a population prepare for democratic governance and the rule of law by imposing a form of benevolent autocracy? Transitional administrations represent the most complex operations attempted by the United Nations. The operations in East Timor and Kosovo are commonly seen as unique in the history of the UN - perhaps never to be repeated. But they may also be seen as the latest in a series of operations that have involved the United Nations in 'state-building' activities, where it has attempted to develop the institutions of government by assuming some or all of those sovereign powers on a temporary basis. The circumstances that have demanded such interventions certainly will be repeated. Seen in the context of earlier UN operations, such as those in Namibia, Cambodia, and Eastern Slavonia, the view that these exceptional circumstances may not recur is somewhat disingenuous. Moreover, the need for such policy research has been brought into sharp focus by the weighty but ambiguous role assigned to the UN in Afghanistan and the possibility of a comparable role in Iraq. This book fills that gap. This development within international affairs has been labelled the “new interventionism” (see for example Yannis 2002b: 826). But not only the absolute numbers increased, also the scope of these missions has undergone some fundamental changes. The mandates of traditional peacekeeping operations are expanded allowing UN forces to be actively engaged in operations which can be better described as peacebuilding missions (Brahimi 2000, Mortimer 2004: 10). However, the term “peacebuilding” is still not integrating the phenomenon of UN forces running the entire domestic administration of post-conflict societies. Within the scientific discussion the term “international interim administration” is therefore seen as more accurate to describe UN operations in territories such as Cambodia, Liberia, and Eastern Slavonia. This article adds to the scientific discourse by focusing on two of the most recent cases of UN Interim Administration: the United Nations Interim Administration Mission in Kosovo (UNMIK) and the United Nations Transitional Administration in East Timor (UNTAET). Whereas the UNTAET ended in 2002 with the release of East Timor into independence, UNMIK is still continuing and the question of the Kosovo’s final status remains open. While the outcome of these missions seems to be very different they were both facing similar difficulties which are characteristically for interim administrations. Therefore this paper is going to point out some specific problems and challenges of these missions. Special attention in this context will be directed towards the following issues. Taking the respective UN resolutions as a starting point for examination the article will take into account the challenges that are derived from the structure of the mandate and the question of state sovereignty in the context of international interim administration. Being amongst the most important aspects within those missions, the article additionally addresses the UN’s organisational capacity to accomplish these wide-ranging missions and the establishment of ad-hoc judicial systems.

UN peace-building missions in Kosovo, Eastern Slavonia, East Timor and Cambodia gave a first impression of the future role of the UN in post-conflict situations: To built up a democratic, peaceful nation after war or civil war’s destruction of the country. But how could that impressive task be managed? Which problems could emerge and which processes guarantee a successful mission? Of course there won’t be a ‘one size fits all’ model but the lessons learned of the experiences could help to manage future tasks. In this context, the UN mission in East Timor is said to be very successful because within a few years a multidimensional project built up a working administration and a viable democratic state out of a completely destroyed infrastructure and scorched earth with thousands of dead or fled inhabitants. But what made this mission so successful? Was it the multidimensional mandate? The international experts involved? The preconditions of the conflict? The small size of the country? Or even the ownership of the East Timorese people in the peace-building process? The question of participation is a very important one, especially with the perspective of the people once being independent. During the UN peace-building-process the foundation of the future nation’s governing structure is laid and it is absolutely crucial to involve local actors in the process of state-building. The problem of the performance for the UN exit of the country after the mission is also a problem of lacking former participation. “No exit without a Strategy” Kofi Annan postulated (quoted in Chesterman et al 2004: 15) - the thinking about the Strategy leads to the problem of participation. But how could one prepare a nation for democracy and good governance from the standpoint of a UN transitional government? The governing structure “benevolent despotism” (Chesterman 2002b) through a multidimensional, centralized mandate is not a very good teaching example. In this work, I would like to focus on one specific theme to analyse - the possibility for the people to participate and the degree of their involvement in the transitional government of the UN. Maybe this task was the key to the overwhelming success of the UN mission in East Timor?
