Book Description
Excerpt from The Theory and Practice of the English Government The purpose of this book is to place before American readers a concise account of the theory and practice of the English government. An effort has been made to present within reasonable compass a description of the actual working of the English government with some reference to its history and theory. In the preparation of the book the writer has had the benefit of the advice and criticisms of several scholars both in England and in the United States. There are a few, however, to whom special acknowledgments are due. Mr. Alfred Fellows and Mr. Henry Smyth, of Birmingham, England, and Professor Emma Mont. McRae, of Purdue University, read the entire manuscript, and made many valuable suggestions and corrections both as to form and content. Professor George H. Emmott, of University College, Liverpool, read the manuscript of the earlier chapters, and gave the writer the benefit of his comprehensive historical and legal knowledge of English institutions. Mr. E. W. Kemmerer, of Purdue University, has also rendered a very valuable service by reading the proof-sheets of the entire book. Book Description
Excerpt from Local Government in England, Vol. 1 of 2 This book is the result of studies, prosecuted for many years, concerning the development of the domestic politics of England during the nineteenth century. What remains to be said of the origin and plan of the book, besides the explanations given in the introductory chapter, is mainly of a personal character. When I came the first time to the shores of England, more than ten years ago, it was as a student of English Law and Constitution entirely imbued with the ideas and judgments which the great German jurist and scholar, Rudolf von Gneist, had expressed in the many legal and political writings of his long career. But soon I discovered that those writings were not only in many ways obsolete, having been long passed by current practice and by modern legislative reforms, but also that the general idea of the modern political history of England, as given by Gneist, stood in inexplicable contradiction to the real development and the true nature of political facts. These first impressions have been strengthened by incessant study in England itself, until out of my doubts of the theories and judgments of Gneist there has resulted a view of modern English politics, independent of, and in essence opposed to, those views of Gneist which have so constantly been accepted as authoritative by continental learning. Here I have not to explain or justify a view which must rather be justified by the book itself. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from The English Constitution: A Commentary on Its Nature and Growth In the introductory chapter, the statement is made that one object of the book is to enable American readers to gain a better knowledge of the American government. It may be an advantage to some readers for me to add that Part I. Was prepared specifically in order that Americans might be able to read with greater profit Bryce's The American Common wealth. To fully appreciate that great work, the American needs to be well grounded in English politics. He must know the present Constitution in its theory and in its practice. Part II. Is designed to answer certain questions often raised in an attempt to understand the present English Constitution. Americans should never forget that, until the founding of the colonies, English history is our history. Nor should they fail to remember that for a hundred years after, there was a per sistent effort to establish in England a government according to what would now be called the American model, - that is, a government based upon an artificial constitution whereby the Legislature and the Executive should be balanced one against the other. It was not until the coming in of the House of Hanover, in 1715, that English constitution-making became of a distinctly different character. It is very legitimate to buy a seat in the House of Commons of England, and equally so for the occupier of that seat, when bought, to suspend any fundamental law ofthe land. And lastly, nothing can be more legitimate than that all people should be taxed accord ing to the humour and caprice of their several governments. Book Description
Excerpt from The Government of England: Its Structure and Its Development The English Constitution forms a part of the Common Law. Our government by King, Lords, and Commons, the mutual relations of these several powers, our Constitution courts of law and of equity, our great offices of State, are all, and from their earliest rudiments have been, known to the law, and recognized by it. Obvious as this proposition now appears, it has not always been followed in practice; even yet, perhaps, it sometimes is not thoroughly understood. To the ingenious inventors of paper constitutions in the last century the unwritten traditions of our political system supplied a favourite subject for sarcasm and contempt. These politicians could not believe in any system of polity which was not expressed in words and figures; where there was no delicate adjustment of powers, and where the right of men to cashier their rulers was not prominently set forth. But the law of political conditions, like the law of property or the law of obligations, or any other portion of our jural system, needs not the formal statement of a code. "That ancient collection of unwritten maxims and customs," of which this branch of our law forms a part, has its own inherent vitality. It is no subtle contrivance of human art, but is one of the forms in which national life is manifested. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
