The trial Judge refused to recall the jury and refused to grant a reserved case. The accused now applies; to this Court for leave to appeal, and on the argument before us counsel for the Crown agreed that we should deal with the matter as if a case had been stated. The following portions of the J udge's charge are, in my opinion, the only ones material to the consideration of the question: "However, this case, like so many unfortunate cases of a similar nature, involves the question of which of two witnesses to believe. You have the two contradictory stories one told En Base. 1914 by Mrs. Sholts, the other by the accused, Schurman," and again' gCHUB'MAN_ "You are the sole judges of the facts. You have heard the evidence of both parties, and it is for you to say which of the-stories is to be believed. You are not bound by any expression of opinion I may make on the facts. It is for you to say which witness you are to believe," and further, "I must say that it makes it very dilficult for you, because there is so little to help you to come to a conclusion. But you must form a conclusion from the evidence. It is for you to say which of these two parties is telling the truth. If you believe that the story of the woman is the correct one, then you must find that the accused is guilty of an attempt to commit the offence charged. If, on the other hand, you believe that the story of the man is correct, then you must find that the woman is a woman of loose character, and, more than that, that she is guilty of telling deliberate lies in.the witnessbox. Both plaintiffs testify that there was no indication that there was anything wrong with the roadway at the point in question until the horse broke through the crust. The city regularly inspected the street, and had its officials inspected it just prior to the accident they could not have discovered t.he defect. I cannot see therefore in what respect then the city was guilty of negligence. The cavities, where they occurred, resulted from the effect of rain on a refilled trench. The earth in the trench settled, while the crust of the roadway remained intact. This is quite to be expected in the natural course of events where an excavation is made and then refilled. Where the Legislature has authorized or sanctioned the construction of a sewer under a roaduay, and the sewer has been constructed without negligence, and every precaution has been observed to prevent injury arising therefrom, the sanction of the Legislature carries with it this consequence, that, if damage results which is the natural consequence of constructing a sewer under a roadway independently of negligence, the city is not liable: Vaughan 2). Tafi Vale Ry., 5 H. & N. 679; 29 L.. Ex. 247; 21 Halsbury, 519. To say that, because subsidence occurred several times in the roadway above the sewer, the city should have anticipated a further subsidence in another portion of the street-with out anything to indicate the existence of the particular cavity----would be, in my opinion, to demand more than was reason able.
