No other name is comparable with his in fame or honor in this singular field of statesmanlike judicial control, - a field of our own marking out and creation, a statesmanship peculiar to our own annals. Marshall may be said to have created for us the principles of interpretation that have governed our national development. He created them like a great lawyer, master of the fundamental conceptions that have enlightened all great lawyers in the administration of law and have made it seem in their hands a system of life, not a mere body of technical rules; he created them also like a great statesman who sees his way as clearly without precedent as with it to those renderings of charter and statute that will vivify their spirit and enlarge their letter without straining a single tissue of the vital stuff of which they are made. A thoughtful English judge has distinguished between those extensions of the meaning of law by interpretation that are the product of insight and conceived in the spirit of the law itself and those that are the product of sheer will, of the mere determination that the law shall mean what it is convenient to have it mean. Marshall's interpretations were the products of insight. His learning was the learning of the seer, saturated with the spirit of the law, instinct with its principle of growth. No other method, no other principle, has legitimate place in a system that depends for its very life upon its integrity, upon the candor and good conscience of its processes, upon keeping faith with its standards and its immemorial promises. Our courts have stood the test, chiefly because John Marshall presided over their processes during the formative period of our national life. He was of the school and temper of Washington. He read constitutions in search of their spirit and purpose and understood them in the light of the conceptions under the influence of which they were framed. Excerpt from Principles of Political Economy: Applied to the Condition, the Resources, and the Institutions of the American People The work was not designed to be wholly controversial and original; besides suggesting the doctrines which are to take the place of those which have been rejected, it was intended to contain a summary of what is most valuable in other treatises upon the subject, so as to form a con venient text-book of instruction in American colleges. Most teachers will probably accept the conclusion which I have formed, after many years' experience, that it is a wearisome and hopeless task to at tempt to instruct a class Of pupils from any Of the English or French treatises upon the science. This volume contains the substance of a course of lectures upon Political Economy, first delivered before the Lowell Institute in Boston five years ago, and afterwards repeated, with many changes and additions, before successive classes in college. Excerpt from Some Leading: Principles of Political Economy Newly Expounded Though the following work is an attempt to recast some considerable portion of Political Economy, I should be sorry it were regarded as in any sense antagonistic in its attitude toward the science built up by the labors of Adam Smith, Malthus, Ricardo, and Mill. On the contrary, my hope is that it will - should its reasonings find acceptance - strengthen, in some sensible degree, and add consistence to that fabric. As regards those assumptions respecting human character and the physical conditions of external nature which constitute the ultimate premises of economic science, the position I have taken is identical with that of the four great writers I have named; and I have endeavored also to follow the method of combined deduction and verification by comparison with facts, which was theirs, and which is, as I believe, the only fruitful, or indeed possible method in economic inquiry. Nor do the final conclusions which I have reached differ very widely on any important points from those at which they had arrived. The points on which I have ventured to join issue with them are what, in Bacon's language, may be called the axiomata media of the science - those intermediate principles by means of which the detailed results are connected with the higher causes which produce them. If I have not deceived myself, there is in this portion of Political Economy, as at present generally received, no small proportion of faulty material; and the present work may be regarded as an attempt, so far as it goes, to replace this element of weakness with matter better fitted to endure the strain of modern criticism. Excerpt from Why the Capitalist?: A Refutation of the Doctrines Prevailing in Conventional Political Economy John Stuart Mill, in the preliminary remarks to his "Principles of Political Economy," says: "It often happens that the universal belief of one age of mankind - a belief from which no one was, nor without an extraordinary effort of genius and courage, could at that time be free - becomes to a subsequent age so palpable an absurdity, that the only difficulty then is to imagine how such a thing can ever have appeared credible." Turgot spoke of the art "of those who set themselves to darken things that are clear to the open mind." He said: "This art consists in never beginning at the beginning, but in rushing into the subject in all its complications, or with some fact that is only an exception, or some circumstance, isolated, farfetched or merely collateral, which does not belong to the essence of the question and goes for nothing in its solution. Like a great geometer who treating of triangles should begin with white triangles as most simple, in order to treat afterwards of blue triangles, then of red triangles, and so on." Add to the foregoing the thought that the writers on political economy, like the generality of mankind, are all constantly influenced by their own desire to attain pleasure and avoid pain; in other words, are swayed by material interests, and we shall have all the reasons why political economy is still spoken of as the dismal science. I am actuated by the same motives that actuate the generality of mankind. I avow my amenability to the same influences. Besides all that, I claim that the experiences of my own life have given me an incentive to pursue an uncommon course of study in such an uncommon way as to enable me to see farther, and to distinguish more clearly the things that will afford me real pleasure and shield me from pain.
