Between 1772 and 1795, Russia, Prussia, and Austria concluded agreements to annex and eradicate the Commonwealth of Poland-Lithuania. With the partitioning of Poland, the dioceses of the Uniate Church (later known as the Greek Catholic Church) were fractured by the borders of three regional hegemons. Larry Wolff's deeply engaging account of these events delves into the politics of the Episcopal elite, the Vatican, and the three rulers behind the partitions: Catherine II of Russia, Frederick II of Prussia, and Joseph II of Austria. Wolff uses correspondence with bishops in the Uniate Church and ministerial communiqus to reveal the nature of state policy as it unfolded. Disunion within the Union adopts methodologies from the history of popular culture pioneered by Natalie Zemon Davis (The Return of Martin Guerre) and Carlo Ginzburg (The Cheese and the Worms) to explore religious experience on a popular level, especially questions of confessional identity and practices of piety. Reflecting on events in the eighteenth century, the American jurist Henry Wheaton referred to the partitions of Poland as 'the most flagrant violation of natural justice and international law' which had occurred 'since Europe first emerged from barbarism'. This was a view with which William Hall concurred, calling the partition an 'immoral act of appropriation' whilst Thomas Lawrence thought it was 'so full of evil' that it found 'no warrant in international law'. In France, Henry Bonfils and Paul Fauchille held a similar view, calling the partitions 'ce grand crime politique'. Robert Redslob also condemned the partitions of Poland and referred to them as a bloody assault on the rights of man and as an insult which had been characterized by a spirit of cynicism. As these views might indicate it would be difficult to find an international lawyer writing in the centuries following those partitions who held a favourable view of what happened. And yet in the eighteenth century few had complained during the attempt to partition the Spanish Empire (in 1698 and 1700) or when Poland was first partitioned (in 1772). What brought about this change in opinion?

In 1807 Napoleon Bonaparte created the Duchy of Warsaw from the Polish lands that had been ceded to France by Prussia. His Civil Code was enforced in the new Duchy too and, unlike the Catholic Church, it allowed the dissolution of marriage by divorce. This book sheds new light on the application of Napoleonic divorce regulations in the Polish lands between 1808-1852. Unlike what has been argued so far, this book demonstrates that divorces were happening frequently in 19th century Poland and even with the same rate as in France.
