Book Description
This book deals with a subject that has recently been the focus of debate and law reform in many jurisdictions: how much scope should spouses have to conclude agreements concerning their financial affairs - and under what circumstances should such agreements be binding and enforceable? These marital agreements include pre-nuptial, post-nuptial and separation agreements. The book is the result of a British Academy-funded research project which investigated and compared the relevant law of England and Wales, Australia, Austria, Belgium, France, Germany, Ireland, the Netherlands, New Zealand, Scotland, Singapore, Spain, Sweden and the jurisdictions of the United States. In addition to chapters on these jurisdictions, the book includes a chapter on the 'English practitioner's view'. It also provides a comparative analysis of the different matrimonial property regimes and the rules on marital agreements that explores underlying themes and principlesand makes recommendations for regulating marital agreements. A key theme is the function and effect of marital agreements in the different jurisdictions. Thus, each chapter first explains the underlying 'default' rules for ancillary relief/matrimonial property and maintenance. It then analyses the current rules for marital agreements, and gives a brief account of the private international law rules. The book provides a comprehensive source of reference on ancillary relief/matrimonial property and maintenance and the rules on pre-nuptial, post-nuptial and separation agreements in 14 jurisdictions. It offers guidance for academics and practitioners dealing with international matters, and a basis for discussions on law reform. 'I applaud the vision and perseverance of Jens Scherpe in having conceived this book and, with so much distinguished help, in now bringing it to birth. I will be using it for many years and I warmly invite my fellow family lawyers across the world to do likewise.' Foreword by The Rt Hon Lord Wilson of Culworth, Justice of the Supreme Court of the United Kingdom

Book Description
"This book is the first complete history of the development of heart surgery. Its story ranges from the observations of the ancient Greeks through early efforts to repair heart wounds in the nineteenth century to the extraordinary advances of the present day. Noted heart surgeon Harris B. Shumacker has scoured the vast literature on heart surgery in many languages and has succeeded in untangling the complex strands of a fascinating story. An active and respected participant in the last half-century of this history, Shumacker brings to his narrative an experts insights and a wealth of first-hand experience." "As a backdrop for what is to come, Shumacker surveys the prehistory of modern heart surgery, but his story begins in earnest in the 1920s and 1930s, when the first attempts were made to operate on the heart and adjacent vessels to correct congenital malformations. He describes the early operations on the great vessels and surface of the heart; intracardiac manipulations upon the beating, functioning, and unsupported heart; and operations carried out within the opened heart." "With the meticulous care of a surgeon, Shumacker retraces the incremental growth in our knowledge of the human heart and its repair with clear discussions of each innovative procedure, both the successes and the failures. He pays special attention to clarifying the individual contributions of the many doctors and researchers throughout the world who have played a role in this still-developing story." "Shumacker concludes with the revolutionary developments of contemporary heart surgery: the heart-lung machine, deep hypothermia and circulatory arrest, cardiac support devices, heart transplants, and the artificial heart. Here is a comprehensive history and an important resource for the medical professional and the medical historian." --Book Jacket.

Book Description
There are a number of important (landmark) cases in the development of Family Law in England and Wales that deserve detailed examination and lend themselves particularly well to historical examination. Family law cases tend to raise highly controversial issues, often on striking facts, frequently provoking wider social debate and/or extensive publicity. Consequently, the landmark cases chosen for this collection provide considerable scope, not only for doctrinal analysis and explanation of the importance and impact of the decisions, but also for in-depth examination of the social or policy developments that influenced them. The stories behind the cases provide a fascinating insight into the complexities of family life and the drama that can be found in the family courts. In recent years, Family Law has seen enormous changes in law's engagement with the notion of 'family', with the enactment, for example, of the Civil Partnership Act 2004, the Gender Recognition Act 2004 and, more recently, the Human Fertilisation and Embryology Act 2008. As we begin to move forward into the new millennium, this is an excellent time to engage in detailed analyses and 'stock-taking' of the landmark decisions, many of which were decided in the 1970s, and which have shaped modern Family Law. This book provides a series of in-depth studies of the key leading cases, and will be of interest to students and lecturers alike.
