The 'State' has been retreating from direct intervention in economic life as more goods and services, the provision of which was once thought to be a 'public' responsibility, are delivered through market mechanisms. Given the need for consistent application of EC law in the internal market, a common core conception of public authority, shielded from the discipline of EC competition law, is needed. The resulting realignment of public and private functions and responsibilities is not a linear and coherent process, especially in light of the changing nature of the European legal integration project and the progressive incorporation of non-economic values in the Treaties.

The term ‘social dumping’ regularly appears in public debates and in policymaking circles. However, due to its ambiguity it is used in a manner that is convenient for individual discourse participants, thus opening the door for misconceptions and ill-grounded accusations. This book systematically examines social dumping in the context of the European integration process. It defines social dumping as the practice, undertaken by self-interested market participants, of undermining or evading existing social regulations with the aim of gaining a competitive advantage. It also shows how the two major EU integration projects the creation of the Internal Market, and EU enlargement to the east and to the south have provided market actors with new incentives and opportunities to contest existing social ‘constraints’. The empirical chapters examine social dumping practices accompanying labour migration, employee posting and cross-border investment distribution. In addition, they outline the process of formation of social standards and trace initiatives at EU and national levels that contribute to the spread of social dumping in Europe. Integration in Europe has been a slow incremental process focusing largely on economic matters. Policy makers have tried to develop greater support for the European Union by such steps as creating pan-European political institutions. Yet significant opposition remains to policies such as the creation of a single currency. What explains continued support for the European Union as well as opposition among some to the loss of national control on some questions? Has the incremental process of integration and the development of institutions and symbols of a united Europe transformed public attitudes towards the European Union? In this book, Matthew Gabel probes the attitudes of the citizens of Europe toward the European Union. He argues that differences in attitudes toward integration are grounded in the different perceptions of how economic integration will affect individuals' economic welfare and how perceptions of economic welfare effect political attitudes. Basing his argument on Easton's idea that where affective support for institutions is low, citizens will base their support for institutions on their utilitarian appraisal of how well the institutions work for them, Gabel contends that in the European Union, citizens' appraisal of the impact of the Union on their individual welfare is crucial because their affective support is quite low. The Treaty of Lisbon (2009) has brought foreign direct investment (FDI) within the scope of the European Union's common commercial policy (CCP). In light of this development, this book analyses the internal and external dimension of EU law and policy in the field of FDI. It takes four perspectives: (i) the operation of the internal market mechanism to direct investment; (ii) the implications of the Lisbon amendments to the CCP under Article 207 TFEU for the Union's competence and practice in the field of FDI; (iii) the interaction between EU law and Member States' bilateral investment treaties (BITs) with third countries; (iv) the interplay between EU law and BITs that are currently in force between two Member States (intra-EU BITs).
