Abstract: The American criminal justice system has historically relied on incarceration to address drug offenses. This reliance on incarceration has contributed to the mass incarceration of people who use drugs and prison overcrowding. In an effort to reduce prison overcrowding, the criminal justice system has turned to non-custodial sentences. Through secondary data analysis, the current study examined the relationship between recidivism and sentence type. Three non-custodial sentences used in Kansas were examined in the current study: court services, community correction, and Kansas Senate Bill 123. Court services is a minimum supervision probation sentence, community corrections is an intensive supervision probation sentence, and Kansas Senate Bill 123 is an intensive supervision probation program that includes mandatory drug treatment. The sample was comprised of people convicted of non-violent drug possession felonies in Kansas from November 2003 to November 2008. Using binary logistic regression, this study found mixed support for labeling theory and specific deterrence theory. The policy implications of the current study are discussed.

After conducting a comprehensive literature search, the authors undertook a meta-analysis to examine the association between correctional education and reductions in recidivism, improvements in employment after release from prison, and other outcomes. The study finds that receiving correctional education while incarcerated reduces inmates' risk of recidivating and may improve their odds of obtaining employment after release from prison.
