Excerpt from The Eclectic Review, Vol. 11: January-June, 1819 Closely connected with this defect in our criminal jurispru dence, is that subject in which so general an interest has been simultaneously excited, and respecting which the House of Lords has pledged itself to institute an inquiry. If it is an acknowledged evil that the sentence should he severer than the punishment, it must be admitted to be an evil of still greater magnitude, that the punishment should be severer than the law. If too wide a discretion is upon the present system entrusted to the judge in acting upon the decision of the jury, the sentence of the judge himself, when 'the punishment is less than death, becomes subject to a discretion scarcely less extensive, and far more liable to abuse, in the person of, the gaoler. The por tentous increase of crime within the last ten years, has had the effect of pressing this subject also, irresistibly upon the public attention. Lord Lansdowne adverts to the papers laid before the House of Lords, from which it appears, that while, in the years 1805, 1806, and 1807, the amount of convictions was 9865, in the years 1816, 1810, and 1817, the number was and the result of the present year promises to be still more appalling. Any speculative inquiry into the primary 'cause of this increase of crime, would, perhaps, be of little practical advantage; 'it is doubtless the result, in a great measure, of the peculiar political circumstances of the country; but from whatever source, ' re marked his Lordship, 'these waters of bitterness have owed, it must depend chie y on the state of the receptacles into which they enter, whether their progress shall, or shall not be accele rated.' Excerpt from The Eclectic Review, Vol. 11: January-June, 1842 That true piety is indispensable for this office, must, one would think, be evident from the nature of the Office itself, which is to allure men to the practice of holiness and virtue. For this reason, there are probably none, at least in our day, who would in so many words contend that he can be qualified to discharge its duties whose life is notoriously immoral, - at Open variance with the plainest precepts of the institute he is commanded to enforce. There is such a palpable contradiction in the idea of setting men to teach what they have never learned; to enjoin what they have never practised; to enforce precepts which they contradict by their example; gravely to propound, as of infinite importance, truths which they either disbelieve or virtually disregard, that few could be brought for a moment to countenance it. Such a spectacle may make the religious sad, and the irreligious merry, but can by no possibility have any other effect. Example, which is Of great force in all moral teaching, is the Christian minister's chief source of influence - that which best illustrates, recommends, and enforces his instructions, and without which the divinest eloquence will but excite a sneer at the cant and hypocrisy of the speaker, and render the unbeliever more Obdu rate. Such cases may therefore be dismissed at once. But there are not a few who think that any man, whose life is marked by a decorous regard to the ordinary proprieties of life, even though exhibiting none of the indications of solid and vital piety, may blamelessly assume the ministerial function, if he be but duly authorized by ecclesiastical authority. Such a notion is common enough amongst those who perversely separate the man from the minister - who invest him with an Official sanctity which is to compensate for his personal deficiencies, or who entertain lax notions of the responsibilities and duties of the sacred function itself. Such a notion, we hope, will never be allowed to prevail amongst ourselves. If that day should ever come, that which has so long been the glory of our ministry, and which has counterpoised its many defects, will be gone. Excerpt from The Eclectic Review, Vol. 11: M, DCCC. LVI; January June We believe, that at the present moment, great responsibility devolves on the office of the critic. It is he who is to adjudicate on conflicting claims, to weigh opposing evidence, to unravel the intricacy of involved precedents, and finally, if it be possible, to deduce therefrom the true laws and principles which shall govern future decisions, and guide the general practice. The works prefixed to the present article are opposing witnesses, or rather contending counsel, brought into the court of public opinion; and after having given to the question raised by the evidence and arguments adduced, mature consideration, we will now endeavour to pronounce a judgment which, though it should fail to settle the question in dispute, may yet tend to reconcile and remove existing difficulties, and, at all events, not augment present confusion. The English Pre-Raphaelite reformation or heresy is the subject on which we propose to treat. The periodical entitled "Art and Poetry" prefixed to this article, may be taken as an ex parte statement of the case by "the Pre-Raphaelite Brethren" themselves, the plaintiffs in the suit. Mr. Ruskin, in his Edinburgh Lectures, is their volunteer counsel, and shows, perhaps, greater zeal than discretion in his advocacy. Mr. Leslie, on the other hand, is engaged in the defence, and seeks to maintain against these radical renovators the authority and rights to which Raphael, by the common consent of three centuries, has been deemed entitled. The case involves important and fundamental considerations: it threatens an utter revolution in acknowledged Art-authorities. If the plaintiffs in the suit should win, the decisions of three centuries are overthrown, ancient landmarks removed, and great names disinherited. The question is complex; the plaintiffs cannot fairly be nonsuited on a bare statement of the matter in dispute: they merit a patient hearing, and have a case worthy of the due deliberation of the court. That the arguments are not unequally balanced, and that each party has its strongholds more easy to defend than to capture, may well be inferred by the obstinate prolongation of the contest without any definite or final result. The conflict, moreover, is not one of mere words, but of deeds. The plaintiffs enforce their arguments by example, and add to the novelty of their faith the startling eccentricities of their works: their words are but a prelude and apology for these works. They thus seek to substantiate their claims and position in the court of public opinion, in order to give to the licence of their practice the sanction of established law.
