There has been no time in the history of South Carolina, Province or State, in which the services of bench and bar have been of more consequence to the community than in that of the fifty years that this work will cover, and none in which the profession has been adorned with greater genius or more profound learning. The battle fields of the South are strewed with the graves of learned lawyers who proved themselves equally capable as leaders in the war to which their patriotism called them as they had been leaders at the bar and in the Senate Chamber. And when the war was over the Reconstruction measures of Congress called for the exercise of the highest qualities of the profession. New and profound questions arose in regard to the fundamental principles of government, and their application to the anomalous condition of the reconstructed States. These had all to be met by the survivors of the war, and their sons, who had obtained their education amidst the greatest difficulties during the long war. We propose to give a true story of the brilliant record of the professional struggles of those who bore themselves so nobly and patiently and successfully through this period. Excerpt from Early Bench and Bar of Illinois Some years ago when in social conversation with two gentlemen of the Bar, I was relating some professional inci dents which had occurred many years before, when one of them suggested that it would be interesting to the profes sion of the present day if I would note down. Events 'which had occurred in the early times and lay them before the public; I promised to do so, and the result was a: series of articles published in the Chicago Legal News. Upon their publication I received many letters from gentlemen of the Bar in various parts of the State, expressing the hope that the articles might be republished in. Book form. I finally revised these articles and prepared them for the press, with several new papers which have not been previously pub lished, and placed them in the hands of the printer, thinking that many incidents and some peculiarities of former times might be thus perpetuated, which may in still later times be considered worth remembering. I do this the more readily as I am probably the only man now living who can speak from personal observations and recollections of events of fifty years and more ago. In the Appendix I have given an address delivered before the State Bar Association on the 24th of January last, and another given before the Chicago Bar Association February 11, 1893, in which will be found some statements germane to the subject, not previously given. Excerpt from The Bench and Bar of Mississippi This work treats only of the dead, with the exception of the last chapter, which is devoted to observations upon the characters of eminent living lawyers who are more than three score and ten years of age; and in its preparation the author has sought to present accurate sketches of the distinguished jurists and lawyers who have graced the jurisprudence of Mississippi, together with an exposition of the peculiar traits of character by which they rose to eminence. It is not assumed, however, that this work comprises the mention of every good man or good lawyer of local repute, but only of such as, owing to their varied pre-eminent qualities, are justly entitled to the fee of eminence. There were many, very many, of the former class whose characters are fully worthy of the most meritorious mention, and even a compendium of whose deserts would fill the pages of many volumes; but it has been the design of the author to embrace only those whose professional careers were characterized by transcendent genius, and which gave marked dignity and elevation to Mississippi jurisprudence. If he has omitted any of this class, the oversight was due to a lack of information respecting their characteristics, and their friends must take upon themselves, in part, the responsibility, if such there be, of withholding intimations which would have led to a thorough inquiry. The lives of lawyers are generally monotonous, and void of noticeable event. They leave, as a general thing, but little record of their merits, and a work devoted exclusively to professional incidents must depend largely upon oral evidence and traditional testimony; and the only question, in those cases, is, to whom did the concurrence of the bar and the voice of the people accord the meed of eminence? Excerpt from The Bench and Bar of Georgia During the Eighteenth Century The result of my search is less than a handful of grain. It may not be beaten into any logical narrative. But a fact here, a fact there, and another yonder may be artificially strung together, and I hope that you will not find that the patchwork is altogether void, as containing matter different from that expressed in its title: "The Bench and Bar of Georgia During the Eighteenth Century." Who was the first man who ever practiced law in Georgia? We know the names of the first judges (2 C. R. 11); even the names of the first jury (1 Stevens' Hist, of Ga. 101), but who can give us the name of the first Georgia lawyer, or indeed of any lawyer that practiced in the Colony prior to the Revolution? The natural place to find the answer to this question would be in the court records. They have been lost, and, consequently, it has been impossible to fully write of the Bench and Bar of Georgia in the 18th Century. But in 1904 the State began the publication of the Colonial Records and made available to the student of Georgia History the Journal kept by William Stephens, in Savannah; the Journal kept by the Earl of Egmond in London and the hitherto unpublished Minutes of the Trustees in London; the Minutes of the Commons House of Assembly, and of the Governor and Council, kept in Savannah from 1754 to 1774, and the Minutes of the House and Council at Savannah and Augusta during the Revolutionary period. The entries in those volumes are for the most part merely formal and must be pieced together and then fused into one in order to furnish the basis of a narrative. But from them all we get an impressionistic picture, if not a photographic reproduction, of life in the little Colony on the Savannah, which would be petty and local but for the fact that they tell of the Beginnings of the Judicial System of a great State.
