Pursuant to a legislative requirement, GAO reviewed whether the net excise tax revenue distributed to the Airport and Airway Trust Fund (AATF) for the fiscal year (FY) ended September 30, 1998, is supported by the underlying records. GAO noted that: (1) this engagement to apply agreed-upon procedures was performed in accordance with standards established by the American Institute of Certified Public Accountants (AICPA); (2) the procedures GAO agreed to perform included: (a) detailed tests of transactions that represent the underlying basis of amounts distributed to AATF; (b) review of Internal Revenue Service's (IRS) quarterly AATF certifications; (c) review of the Department of the Treasury Financial Management Service adjustments to AATF for FY 1998; (d) review of the Office of the Tax Analysis process for estimating amounts to be distributed to AATF for the fourth quarter of FY 1998; (e) comparison of net excise tax distributions to AATF during FY 1998 and amounts reported in the financial statements prepared by the Bureau of Public Debt for AATF and the Federal Aviation Administration's consolidated financial statements; and (f) review of key reconciliations of IRS records to Treasury records; (3) GAO was not engaged to, and did not, perform an audit, the objective of which would be the to, and did not, perform an audit, the objective of which would be the expression of an opinion on the net taxes distributed to AATF; (4) accordingly, GAO does not express such an opinion; (5) GAO completed the agreed-upon procedures on February 12, 1999; (6) in performing the agreed-upon procedures, GAO conducted its work in accordance with generally accepted government auditing standards, which incorporate financial audit and attestation standards established by AICPA; and (7) these standards also provide guidance when performing and reporting the results of agreed-upon procedures.

"This testimony discusses the status of the Airport and Airway Trust Fund (Trust Fund). Established in 1970, the Trust Fund helps finance the Federal Aviation Administration's (FAA) investments in the airport and airway system, such as construction and safety improvements at airports and technological upgrades to the air traffic control system, as well as FAA operations, such as providing air traffic control and conducting safety inspections. FAA, the Trust Fund, and the excise taxes that support the Trust Fund (which are discussed later in this statement) must all be periodically reauthorized. The most recent reauthorization expired at the end of fiscal year 2007. Proposed reauthorization legislation was considered but not enacted in the 110th and 111th Congresses, although several short-term measures were passed to extend the authorization of aviation programs, funding, and Trust Fund revenue collections. The latest of these extensions--the Airport and Airway Extension Act of 2010, Part IV--was enacted on December 22, 2010, extending FAA programs, expenditure authority, and aviation trust fund revenue collections through March 31, 2011. The financial health of the Trust Fund is important to ensure sustainable funding for a safe and efficient aviation system without increasing demands on general revenues. This testimony provides an update on the status of the Airport and Airway Trust Fund, including the current financial condition of the Trust Fund, anticipated Trust Fund expenditures for planning and implementing improvements in the nation's air traffic management system that are expected to enhance the safety and capacity of the air transport system, and options for ensuring a sustainable Trust Fund. This statement draws on our body of work on these issues, supplemented with updated information on the Trust Fund from FAA and the Congressional Budget Office. Pursuant to a congressional request, GAO examined the proposal by a coalition of the seven largest U.S. airlines to replace the ticket tax with user fees, focusing on: (1) whether the ticket tax should be replaced by a different fee system; (2) what the potential competitive impacts of the fees proposed by the coalition airlines would be; (3) what factors need to be considered if a new fee system were to be developed; and (4) the implications on the Federal Aviation Administration's (FAA) budget of reinstating or not reinstating the taxes that finance the Airport and Airway Trust Fund. GAO found that: (1) because the ticket tax is based on the fares paid by travelers and not an allocation of actual FAA costs, it may not fairly allocate the system's costs among the users; (2) the coalition airlines' proposal to replace the ticket tax with user fees only incorporates factors that would substantially increase the fees paid by low-fare and small airlines and decrease the fees paid by the seven coalition airlines; (3) the proposal would dramatically redistribute the cost burden among airlines and could have substantial implications for domestic competition; (4) any replacement system for the ticket tax would need to account for the wide range of costs incurred by FAA in managing the airport and airway system; (5) the views of all affected parties, not just any particular group of airlines, would need to be included in assessing the mechanisms for financing the airport and airway system; and (6) Congress established a commission to study how best to meet FAA financing needs which will help ensure that, in the long term, FAA has a secure funding source, commercial users of the system pay their fair share, and a strong, competitive airline industry continues to exist.
