Book Description
Excerpt from Reasons for Abolishing Capital Punishment Conservatism is, however, an important element, and we would not under-rate its value. It is the brake on the car of Radicalism - the catch-pin in the cog-wheel of reform the ballast in the old ship Progress - the constant check upon precipitate action. In this light, it is an admirable element. As sentry, it is unsurpassed; for, as Progress carries trench after trench of the enemy, conservatism is placed on guard, and never was trusty friend a more faithful sentinel. Once on guard, it never deserts its post, but true to its negative instincts - to every demand made upon it, it simply shakes its head and says nay. Book Description
Excerpt from Crime and Capital Punishment: Some Recent Studies In November, 1976, the Commonwealth of Massachusetts, arguably the most liberal state in the nation, put a gun-control proposition on its ballot. The proposal was defeated by what Newsweek called a stunning 3 - l margin. Presumably a question on the same ballot about restoring the death penalty would not have fared so badly, for a capital punishment bill had Sailed through the Massachusetts Legislature, which failed later by only one vote to override the Governor's veto. In December, 1976, New Jersey became the 35th state since 1972 to pass new laws that provided capital sanctions in certain homicide cases. The events in Massachusetts and the nest of the nation make clear that, rightly or wrongly, the restoration of capital punishment has become the linchpin of the American people's response to the doubling of murder rates in the last decade. Gun control measures, attempts to reduce media violence, and more general social and economic reforms have been accorded a much lower priority in the national consensus. It seems probable that, first erratically, then more regularly, executions will take place in America throughout the forseeable future. Book Description
Excerpt from Thoughts on the Death Penalty The design of punishment is to prevent the commission of crimes and to repair the injury that hath been done thereby to Society or the individual. And it hath been found by experience that these objects are better obtained by moderate but certain penalties, than by severe and excessive punishment: and it ts the duty of every government to endeavor to reform rather than exterminate offenders. And the punishment of dentin ought never to be inflicted where it is not absolutely necessary to the public safety - Laws qf' Pennsylvania. Stat. Qf21794. A preliminary list was prepared in typewritten form and sent to each State library or legislative reference library, where such existed. Results in the form of additional titles or suggestions were received from the following States: Connecticut Indiana Kansas Maryland (Baltimore) Massachusetts Ohio Rhode Island Texas Virginia Wisconsin The material is gathered under three heads: General discussions, writings in favor of capital punishment, and those opposed to capital punishment.
