"This volume contains the proceedings of the 5th Schengen Colloquium that was held on 23 and 24 January 1997 at EIPA in Maastricht. Two major themes were selected, namely judicial cooperation and drugs policy. Prominent insiders provide us with an interesting insight into the Schengen policy-making process in both of these fields. In the field of judicial cooperation (which still lags far behind police cooperation), readers are offered various perspectives, some of which emanate from the European institutions (the European Commission and the Council Secretariat), and others from practitioners and academics. The creation of a European Judicial Space, a network of magistrates, a European Prosecution Service, 'exporting' the National Magistrate model as found in Belgium, or a system of liaison magistrates on a bilateral basis... which provides the best solution for effective judicial cooperation in Europe? As far as drug policy is concerned, we sometimes forget that the approach is not always a repressive one. Amidst international controversy, the Dutch authorities maintain that a preventive, health oriented approach may be more successful than a repressive one. However, at the level of practical police cooperation, solutions are found in more intensive controls along the motorway where the drugs are being transported, and in regional multiagency cooperation across the borders. Significant contributions in this volume concern the incorporation of Schengen into the new Treaty of Amsterdam and the problem of differentiated integration, the enlaregement of the Schengen group (i.e. the accession of the Nordic states), the transparency and the accountability of Schengen, the development of multilateral and bilateral agreements, and the latest developments concering visa and asylum policy. The main objective of this book is to present the on-going process of European integration via a comprehensive analysis of the institutional dynamics of, and politics linked with, the emerging migration law and policy of the European Union. More specifically, it presents the historical evolution, the main institutional legislative and policy steps, the position of, and interactions among, the different actors, and the factors impeding the formation of a common policy at EU level. On this basis a critical analysis is provided of the main institutional problems, the current policy framework, the overarching rationale as well as of the content and quality of the nascent EU migration law. The book is divided into three parts. The first two parts provide a comprehensive study of the institutional framework and the substantive EC/EU law respectively. The third and final part provides a more general analysis of the policy-making process. Since the major achievements in the field of migration are recent, the book focuses to a great extent on the post-Amsterdam era. However, for reasons of coherence and in order to better evaluate recent developments, a concise overview of the origins of this policy is provided. Moreover, special emphasis is placed on the Schengen acquis, since its mark on European affairs has been and remains pronounced. This book analyses the cooperation between the European Union and the United States on internal security and counter-terrorism since the 9/11 terrorist attacks. In particular, four areas of cooperation are examined: customs and supply chain security; judicial cooperation (the mutual legal assistance and extradition agreements); law enforcement cooperation (the Europol-US agreements); and the EU-US agreements for the sharing of air passengers’ data (PNR agreements). These cases are analysed through a conceptual framework based on the theories of international regimes, with the data being drawn from an extensive documentary analysis of media sources collected through the 'Nexis' database, official documents, and from 13 semi-structured elite interviews with US and EU officials. The book argues that the EU and the US have established a transatlantic internal security regime based on shared principles, norms, rules, and interests. While at the beginning of this process the EU had a more reactive and passive stance at the later stages both the EU and the US were active in shaping the transatlantic political agenda and negotiations. The book demonstrates how the EU has had a much more proactive role in its relations with the US than has often been assumed in the current literature. This book will be of much interest to students of EU policy, foreign policy, international security and IR in general.

This book provides the first in-depth account of how opt-outs work in practice. It examines the most controversial cases of differentiated integration: the British and Danish opt-outs from Economic and Monetary Union and European policies on borders, asylum, migration, internal security and justice.
