Excerpt from Reports of Cases Civil and Criminal, Vol. 1 of 6: In the United States Circuit Court of the District of Columbia, From 1801 to 1841 By the Act of Congress of the 13th of February 1801, the Congress of the United States passed an act entitled "An act to provide for the more convenient organization of the Courts of the United States." By that act the United States were divided into twenty-two districts, and these subdivided into six circuits, in each of which, except the sixth, there were to be "three judges of the United States, to be called Circuit Judges, one of whom was to be commissioned as Chief Judge;" and they were to hold Circuit Courts in their respective Circuits. Afterward in the same session, Congress passed the act of the 27th of February 1801 entitled "An Act concerning the District of Columbia," and by the third section thereof, erected, upon the same model, a Circuit Court for the District of Columbia, "to consist of one Chief Judge and two Assistant Judges;" and conferred upon "the said Court and the Judges thereof" "all the powers by law vested in the Circuit Courts and the Judges of the Circuit Courts of the United States;" evidently referring to the act of the 13th of February 1801, which they had previously passed at the same session; for, before that act, there had been no Judges of the Circuit Courts of the United States, eo nomine - the Circuit Courts being then held by one Justice of the Supreme Court of the United States and the Judge of the District Court of the District in which the Circuit Court was, for the time being, sitting.
