Appellant has submitted an elaborate brief and argument in support of the errors assigned, to which no reply has been made by the appellee. We have given the case all the necessary consideration, as we think, and have come to the conclusion that the order of the circuit court approving the report of the commissioners must be reversed, for reasons we will brie y give.
