Excerpt from Reports of Cases Argued and Determined in the High Court of Errors and Appeals for the State of Mississippi, Vol. 10: Containing Cases for January Term, 1848 Tms volume contains one hundred and five cases; and includes all the opinions not reported in volume nine, which were delivered at the January session, 1848, except, of course, those marked not to be reported. At that session the court delivered nearly two hun dred and fifty written opinions. It will be seen, by an inspection of this volume, that the reporter publishes only a condensed statement of the arguments of counsel, making them accord as nearly as possible with the requirement of the legislature, which limits the briefs to a concise statement of the points submitted, and a like reference to the authorities cited on both sides. It was clearly not the expectation of the legislature that the labor of abridging these argu ments should fall on the reporter. The phraseology of the law shows that counsel were expected to furnish their briefs prepared for publication according to the rule prescribed, and yet in not more than a half dozen instances has the requirement been complied with; the consequence has been that the labors of the reporter have been greatly augmented in the work of pruning, abridging and condensing arguments at the risk, in many cases, of giving dissatisfaction, if not offence.
