Por una parte, la televisión en abierto cuenta con determinadas características, como la provisión pública de una parte relevante del mercado, la gratuidad para el usuario y la competencia por los espacios publicitarios que hacen que su impacto sobre el sector de las comunicaciones electrónicas sea potencialmente menor. Ahora bien, iniciativas tendentes a crear canales de pago sobre la televisión digital modifican sustancialmente esta diferenciación. El fenómeno televisivo no sólo ha experimentado y vive importantes cambios en sus ingresos, en la tecnología para su difusión o las infraestructuras en las que se soporta, sino también la regulación del sector audiovisual. Así, en el caso español nos encontramos con que una de las señas de identidad que conformaban el marco jurídico del audiovisual español como era la dispersión normativa, derivada del gran número de leyes y normas dirigidas a este sector ya sea desde una perspectiva geográfica derivada de una determinada cobertura territorial, ya una determinada regulación en función de la titularidad de la entidad que gestiona el servicio de difusión, pública o privada; o por otro lado, dependiendo de la infraestructura que se utilice para la transmisión y difusión de la señal de televisión, ha encontrado un punto de inflexión en la aprobación de la Ley General de la Comunicación Audiovisual en 2010.
