A revolução digital vem provocando grandes fissuras na estrutura dogmática do direito do trabalho, que podem comprometer o enforcement de seu sistema normativo, como balizador de conduta. Esta obra, fruto da tese de pós-doutorado em Democracia e Direitos Humanos da Faculdade de Direito da Universidade de Coimbra (Portugal), tem o escopo de analisar a matéria com foco no direito coletivo do trabalho. Aborda a importância da Análise Econômica do Direito e da Teoria dos Jogos para a solução dos conflitos coletivos. Ressalta como os novos tipos de relações de trabalho demandam a formação de um modelo próprio para aferir a imputação de responsabilidade trabalhista, um tertium genus distinto da tipologia civilista (objetiva/subjetiva). Analisa os efeitos da revolução digital no modelo sindical existente e aponta a necessidade de mudanças, para que a autonomia privada coletiva possa ser exercida para garantir proteção aos direitos fundamentais nas novas relações de trabalho, inclusive no âmbito internacional. Destaca a importância de promover a reconfiguração da negociação coletiva trabalhista, para abranger novos temas de direito material e processual, ensejando a formulação de outras regras de hermenêutica. A reconstrução do direito coletivo do trabalho vem exigindo a ressignificação do princípio da solidariedade por novos marcos axiológicos, que consigam resgatar a primazia da nova realidade fática como parte integrante do alicerce, de um direito voltado à proteção dos direitos fundamentais dos trabalhadores, para possibilitar a republicana articulação entre o regramento posto pelo Estado e as normas negociadas pelos corpos intermediários, que integram a nação brasileira, a fim de viabilizar a implantação de um efetivo desenvolvimento sustentável.
