The spread of weapons of mass destruction poses one of the greatest threats to international peace and security in modern times--the specter of nuclear, chemical, and biological weapons looms over relations among many countries. The September 11 tragedy and other terrorist attacks have been painful warnings about gaps in nonproliferation policies and regimes, specifically with regard to nonstate actors. In this volume, experts in nonproliferation studies examine challenges faced by the international community and propose directions for national and international policy making and lawmaking. The first group of essays outlines the primary threats posed by WMD proliferation and terrorism. Essays in the second section analyze existing treaties and other normative regimes, including the Nuclear Non-Proliferation Treaty and the Chemical Weapons and Biological Weapons Conventions, and recommend ways to address the challenges to their effectiveness. As the remaining superpower in the post-Cold War world, the U.S. needs to reevaluate its policy toward the growing threat to U.S. national interests and the effects of weapons of mass destruction (WMD), specifically nuclear devices, and their use by terrorist groups against U.S. interests abroad. As the world reacts to the implosion of the former Soviet Union, there are increased numbers of nations and possibly terrorist groups trying to become players in the international arena. This study describes the ease of obtaining the scientific knowledge, plans, and materials to enable a terrorist's construction of a nuclear device. It also analyzes motivation of terrorist groups, concluding that a nuclear weapon, capable of inflicting violence in the extreme, fulfills the terrorist's goal of violence in support of a political agenda or to inspire radical change. Given the guidance from the national level, this study proposes a series of policy options available to the NCA for application in an aggressive counterproliferation policy. Finally, the U.S. must rapidly reorganize its counterproliferation structure and methods to streamline a more aggressive approach that is recognized and feared by potential nuclear terrorists; augment current political efforts with a clearly defined counterproliferation military mission and associated doctrine.

This dissertation is about nuclear weapons proliferation by states and threat of nuclear terrorism arising from non-state actors. It comprises three distinct papers. Paper 1 (Chapter 1) discusses applicability of international law of non-proliferation of nuclear weapons to non-state actors. Specifically, it focusses on the ability of international law to constrain non-state actors’ activities that can potentially lead to nuclear terrorism and to punish non-state actors if they commit nuclear terrorism. Paper 2 (Chapter 2) is about causes of nuclear weapons proliferation by states. Using the methodology of case studies, it focuses on Iran, North Korea, and South Korea to comprehend whether Scott Sagan’s security model, domestic politics model, and normative model apply in these states’ attempts to acquire nuclear weapons. Paper 3 (Chapter 3) studies theories that shed light on terrorists’ motivation to acquire nuclear weapons for perpetrating nuclear terrorism. The specific focus in this paper is on three case studies of Aum Shinrikyo, Al Qaeda, and ISIS, examined in light of Dumas’ taxonomy of terrorist groups’ characteristics. Together, these three papers view the issue of nuclear weapons proliferation from three different angles.

This book examines the state of the nuclear non-proliferation regime and the issues it faces in the early 21st century. Despite the fact that most countries in the world have signed the Non-Proliferation Treaty (NPT) there is growing concern that the NPT is in serious trouble and may not be able to stop the further spread of nuclear weapons. If so, international stability will be undermined, with potentially disastrous consequences, and the vision of a nuclear weapon-free world will become utterly unrealistic. More specifically, the NPT is exposed to four main challenges, explored in this book: challenges from outside, as three countries that have not signed the Treaty – Israel, India and Pakistan – are known to possess nuclear weapons; challenges from within, as some countries that have signed on to the Treaty as non-nuclear weapons states have nevertheless developed or are suspected to be trying to develop nuclear weapons (North Korea and Iran being cases in point); challenges from below in the shape of terrorists and other non-state actors who may want to acquire radioactive materials or even nuclear weapons; and, finally, challenges from above due to the perceived failure of the five legal nuclear weapons states to keep their part of the ‘double bargain’ made by the parties of the NPT and take serious steps towards nuclear disarmament. This book will be of much interest to students of nuclear proliferation, international security, war and conflict studies and IR in general.
