Book Description
This study empirically investigates the transposition patterns of European Union EU directives in 15 Member States and in 5 major sectors of the economy with a view to analysing the politicalndash;economic reasons behind sector and national differences in national execution measures. Specifically, we analyse whether, in the course of transposition, EU directives pass the respective national parliaments or not. Neglected in the scientific literature so far, this question is highly relevant from a normative political perspective and complements the debate on the EU's; democratic deficit by focusing on the national implementation of EU law. Based on information contained in CELEX and EUR-lex, our newly constructed dataset allows us to analyse Member States' transposition performances in a novel fashion, namely across time, Member States as well as policy areas. Our empirical analysis reveals generally low primary transposition ratios. Put differently, most of EU directives are transposed by national executives rather than national legislators. Further, remarkable differences in primary transposition ratios are detected along all three data dimensions. We hypothesize that national political-institutional constellations, economic sector characteristics and EU membership benefits are the main explanatory factors behind these differences. (JEL codes: D70, D78, F50, F53, H77).

Comparative Competition Law
Author: John Duns
Publisher: Edward Elgar Publishing
ISBN: 1785362577
Category : Law
Languages : en
Pages : 529
Book Description
Comparative Competition Law examines the key global issues facing competition law and policy. This volume’s specially commissioned chapters by leading writers from the United States, Europe, Asia, South America, and Australia provide a synthesis of how these current issues are addressed by drawing on the approaches taken in different jurisdictions around the world. Expert contributors examine the regulation of core competitive conduct by comparing substantive law approaches in the US and the EU. The book then explores issues of enforcement – such as the regulator’s powers, whether to criminalize anti-competitive conduct, the degree to which private enforcement ought to be encouraged, and the extraterritorial scope of domestic laws. Finally, the book discusses how competition law is being implemented in a variety of countries, including Japan, China, Brazil, Chile, and Colombia. This scholarly analysis of the key substantive, procedural, and remedial challenges facing global competition law policymakers offers a comparative framework to facilitate a better understanding of relevant policies. This collection of global perspectives will be of great interest to scholars and students of competition law, microeconomics, and regulatory studies. Competition law regulators, policy makers, and law practitioners will also find this book an invaluable resource.

Adoption of EU Business and Human Rights Policy
Author: Peter Drahn
Publisher: Springer Nature
ISBN: 3030469352
Category : Political Science
Languages : en
Pages : 281
Book Description
This book explores how and why the transposition of EU directives in the new and contentious policy area ‘Business and Human Rights’ differs between member states. It reveals the extent to which individual member states are pursuing diverging approaches in dealing with the ‘discretionary space’ in EU directives, and highlights theoretical and political explanations. Drawing on historical institutionalism and rational choice institutionalism, the book establishes a link between the degree of corporatism in a given political economy and government behaviour in terms of Business and Human Rights policy. Moreover, it identifies political salience within the policy subsystem as a pertinent factor for explaining national transposition outcomes.
