A l'ère de la mondialisation, le modèle libéral et démocratique de politique criminelle que nous connaissions jusqu'à présent en Europe se trouve en équilibre fragile, car il subit de nombreuses perturbations provenant le plus souvent de sources extraétatiques. La politique criminelle balance entre politique sécuritaire et libérale ; et en même temps, sous l'influence du marché global, entre zones de droit et de non-droit (pénal). Face aux nouveaux dangers, on constate un double standard. D'une part, répression et d'autre part, non seulement absence de répression, mais qui plus est, non-intervention du système pénal, quand le criminel se trouve être une société transnationale. Quelles sont les relations entre mondialisation, politique criminelle, Etat et Démocratie ? Dans une crise économique provoquée par le néolibéralisme, qui désormais détermine tous les choix et les réponses du Droit, il semble que tous ont succombé aux règles de la mondialisation. En outre, cette dernière, secondée par les nouvelles technologies, pousse la politique criminelle vers un modèle totalitaire sous la gouvernante globale. Le vrai danger n'est pas seulement que le modèle libéral de politique criminelle se perde, mais que tout l'édifice du Droit avec l'idée même de Justice ne s'écroule avec lui. This book examines how legal, political, and rights discourses, security policies and practices migrate and translate across the North Atlantic. The complex relationship between liberty and security has been fundamentally recast and contested in liberal democracies since the start of the 'global war on terror'. In addition to recognizing new agencies, political pressures, and new sensitivities to difference, it is important that not to over-state the novelty of the post-9/11 era: the war on terror simply made possible the intensification, expansion, or strengthening of policies already in existence, or simply enabled the shutting down of debate. This volume critically explores the basis and the goal of punishment from the standpoint of the right to punish. Studies and works dedicated to punishment are scarce compared to those dedicated to Crime Theory or some aspect thereof. The book reviews the main doctrines that have dealt with the theme of punishment from Antiquity to the present, not limiting itself to the legal-philosophical sphere but also analyzing the contributions from other social sciences. It then explores how these are reflected in the sphere of Positive Law. Moving from the most abstract and general to the most concrete and specific, various themes relating to the concept of punishment are distinguished. These themes are not exactly equivalent but are, nevertheless, often confused with one another. They are: Punishment; Punitive Practice; Sentence and Penalty. Of these the third – Sentence, which is almost the least generic concept dealt with, having to do with that area of law which basically constitutes Criminal Law – forms the central part of the work. In this section, via a dual structure, the distinction is made between punishments and deterrents, as the prime types of punitive practice, with a distinct historical tradition, diverse bases and functions, around which different sorts of theories and schools have developed. The book ends with a series of critical conclusions as to what, in the opinion of the authors, should be a correct conception of punishment.
