La aplicación de la pena como sanción penal a los condenados por la comisión de un ilícito penal debe cumplir la finalidad que se propone, de forma tal que no más ni menos que lo necesarios. Bajo la constante vigilancia de principios constitucionales e infraconstitucionales como la dignidad de la persona humana, la celeridad procesal y la presunción de inocencia, el Estado puede imponer al infractor, en el curso del proceso penal, las medidas cautelares que priven o restrinjan el goce de sus derechos. Tales medidas, que se aplican antes de la sentencia condenatoria firme, no tienen naturaleza de pena, sino de garantía de que el proceso penal continuará sin los obstáculos que puedan ser creados por el investigado o acusado. En cualquier caso, estas medidas tienen un grado penoso que puede ser de mayor intensidad (como la prisión preventiva) o de menor intensidad (como la prohibición de acudir a determinados lugares), dependiendo de la forma de privación o restricción de los derechos de la persona infractora. Por ello, en este trabajo se analizará si esas medidas cautelares son funcionalmente equivalentes a las sanciones penales impuestas por el Estado. Para ello, es necesario entender qué es una pena y cómo se aplica actualmente; qué son las medidas cautelares y cómo influyen en los derechos individuales del infractor y cómo funciona el instituto de la detracción. En virtud de la ausencia de previsión legal en Brasil, se investigaron diversos casos de ejecución penal para ver qué condiciones se imponen para el cumplimiento de la pena en el régimen abierto, con el fin de evaluar la real equivalencia con las medidas cautelares legalmente previstas. Como resultado de estos análisis, fue posible concluir que la aplicación de medidas cautelares en el curso del proceso penal resulta en una restricción al pleno goce de derechos por parte del infractor; y que ellas tienen una equivalencia funcional con las penas aplicadas. Así, la previsión de detracción de las medidas cautelares en la legislación uruguaya es correcta, mientras que en Brasil carece de reglamentación para ser realizada.
