In April 2006, Massachusetts passed legislation that aims to achieve near-universal health insurance coverage by expanding Medicaid and State Children's Health Insurance Program (SCHIP) eligibility, providing premium subsidies for certain individuals, and mandating the purchase of insurance for those who can afford it. To make private health insurance plans more affordable and accessible, it modifies state insurance laws (e.g., it merges the state's non-group and small group markets) and creates a public entity called the Connector to serve as a clearinghouse for the purchase of insurance by small employers and individuals who are not offered subsidized insurance by a large employer. To pay for the legislation, the state will redirect some existing Medicaid funds that are used to reimburse health care providers (primarily hospitals) for treating uninsured and other patients who generate uncompensated care costs. It will also obtain additional federal Medicaid and SCHIP dollars using new state general fund appropriations and revenues from employers that do not offer health insurance. Another significant source of funding, while not necessarily flowing through state coffers, is the mandate that requires individuals to purchase insurance or face financial penalties. Over time, the state expects to redirect additional funds from uncompensated care reimbursement to other uses (e.g., premium subsidies) as its uninsured rate declines. However, the legislation continues to provide significant support for hospitals and other providers. This report highlights major elements of the Massachusetts legislation and raises issues that Congress and other observers may consider as details of the state's health reform plan are worked out during implementation. As Massachusetts' landmark effort to reach nearly universal health coverage unfolds, the state is now focusing on employers to take steps to increase coverage. All employersâ€"except firms with fewer than 11 workersâ€"face new requirements under the 2006 law, including establishing Section 125, or cafeteria, plans to allow workers to purchase insurance with pre-tax dollars and paying a $295 annual fee if they do not make a “fair and reasonableâ€ŗ contribution to the cost of workers' coverage. Through interviews with Massachusetts health care leaders (see Data Source), the Center for Studying Health System Change (HSC) examined how the law is likely to affect employer decisions to offer health insurance to workers and employee decisions to purchase coverage. Market observers believe many small firms may be unaware of specific requirements and that some could prove onerous. Moreover, the largest impact on small employers may come from the individual mandate for all residents to have a minimum level of health insurance. This mandate may add costs for firms if more workers take up coverage offers, seek more generous coverage or pressure employers to offer coverage. Despite reform of the individual and small group markets, including development of new insurance products, concerns remain about the affordability of coverage and the ability to stem rising health care costs.

The 2010 national health reform legislation -- the Patient Protection and Affordable Care Act (PPACA) -- is modeled on Massachusetts' 2006 landmark reform effort. As in Massachusetts, national reform includes expansions of public programs, the creation of health insurance exchanges, subsidies for low- and moderate-income individuals, an individual mandate, and requirements for employers, among other provisions. Given the strong parallels between Massachusetts' health reform initiative and national health reform, the experiences in the Bay State provide insights into the potential effects of PPACA.

Building on a long history of health reform efforts, the state embarked on an ambitious plan to promote shared individual, employer, and government responsibility. This brief examines Massachusetts' implementation efforts over the last six years and looks to what lies ahead under federal health reform. Massachusetts succeeded in expanding coverage to nearly all state residents, and residents have experienced gains in access to health care serivces. However the state continues to struggle with rising health care costs. In addition, Massachusetts must make some changes in order to fully comply with federal health reform.
