Strategic Litigation Manual: From Theory to Practice, Lessons from Colombia and Lebanon” aims to address every step of the process of strategic litigation. The first part discusses how to select a strategic case and its components; followed by part two, which provides practical insights on the litigation itself; and the part three explores the post-decision phase. In that sense, the manual contains ten key steps that should be developed in a human rights litigation strategy. These steps include identifying the injustice to be remedied, envisioning the goal, developing a legal strategy, selecting the parties, assessing risks and resources, collecting evidence, developing legal arguments, building an outreach strategy, ensuring that a win is effective or investing in a loss and, learning and retooling. The manual presents a theoretical conception of each of these steps, followed by an illustration of real case examples gathered from the litigation experience of Dejusticia and The Legal Agenda, allowing the reader to understand strategic litigation in theory and practice. This model is not meant to be prescriptive and it is based in our practice on litigation. It is intended to be used as a toolkit to be improved upon with lessons learned from every case. As learning is a key pillar of this model, we encourage readers to retool the model and keep improving it with each new case they pursue.

This book presents a comparative analysis of the struggles of Latin American indigenous peoples for effective representation in national political systems in the region. Through a detailed exploration of the political dynamics of indigenous groups and examples of mechanisms of political representation, the studies in this book reveal how power relations, cleavages and indigenous civil society organizations are essential to our understanding of indigenous political participation. These studies closely inspect how collective action builds up at local level in grassroots organizations, and how it then articulates or not with larger mechanisms of regional and national political representation, providing a more comprehensive and comparative assessment of why and when representation works and fails for indigenous people. This contributed volume is organized around one general and comparative chapter on indigenous political representation in Latin America followed by eight case studies, divided into three main groups. The first group includes cases with a more inclusive political environment, such as Bolivia, Ecuador and Guatemala. The second group brings together cases with certain representation and/or active indigenous elites: Colombia, Mexico, and Paraguay. Tthe third group presents outlier cases with potential indigenous issues: Peru and Chile. Finally, the last chapter brings together reflections on how mechanisms for effective political representation can be improved and how indigenous organizations can be fostered to ensure effective political representation. Sociology of Discourse takes the perspective that collective actors like social movements are capable of creating social change from below by creating new institutions through alternative discourses. Institutionalization becomes a process of moving away from existing institutions towards creating new ones. While discourses entail openness and enable the questioning of what is instituted, institutions offer continuity and stability to social mobilizations. This dual movement of openness and stabilization explains how social struggles ensure their continuity, without completely assuming the logic of the dominant order. The book proposes an analytical model of social change, which is unfolded through three intertwined areas: discourse, communication, and institution.
