Le service public, tel qu'entendu par le droit administratif français, et dont le service postal est l'archétype st confronté au droit communautaire, qui s'applique de manière sectorisée et interdit les monopoles. Parallèlement, s'est imposée la soumission des services publics industriels et commerciaux aux règles communautaires de concurrence. Mais les relations entre la notion de service public et le droit communautaire ne se limitent pas à une simple confrontation. En effet, le droit communautaire confirme l'existence de prestations d'intérèt général sous la forme de services universels. Surtout, les missions assurées par les entreprises de service public, peuvent ètre qualifiées de services d'intérèt économique général. Or ces services n'apparaissent plus seulement comme des dérogations aux règles de concurrence du traité mais jouent un rôle de cohésion sociale et territoriale et sont consacrée par la Charte des droits fondamentaux de l'UE. Il s'opère donc un rééquilibrage au sein des traités fondateurs.
