L'immixtion dans les affaires d'autrui, en ce qu'elle évoque le non-respect d'un domaine réservé, suscite instinctivement la méfiance et est généralement perçue comme une atteinte intolérable au secret des personnes et à leur autonomie. Le droit pénal, en tant que protecteur des libertés individuelles, est donc naturellement amené à saisir le phénomène et à le prohiber lorsqu'il revêt la gravité exigée pour l'application de la répression étatique. Toutefois, la réponse pénale ne se résume pas, en ce domaine, à la répression des immixtion les plus graves. L'attitude du droit pénal diffère, en effet, selon qu'il s'agit d'une immixtion-indiscrétion ou d'une immixtion-gestion. L'immixtion-indiscrétion, qui désigne le fait de prendre indûment connaissance d'informations propres à un tiers, fait l'objet d'une interdiction de principe. face au développement des technologies modernes permettant les indiscrétion les plus insidieuses, le droit pénal a su s'adapter en multipliant les incriminations d'atteinte au secret des personnes. Certes, de nombreuses exceptions au principe sont admises et la montée de la philosophie sécuritaire face aux évolutions de la délinquance a recemment conduit à l'accroisement des immixtions permises. Cependant, en dépit de leur nombre, ces exceptions n'infirment pas le principe d'interdiction de l'immixtion. Elles sont principalement reconnues au seul profit des autorités publiques, en vue de la protection de l'ordre public, et répondent à un régime strict gouverné par les principes de légalité, de nécéssité et de proportionnalité.L'immixtion-gestion, c'est-à-dire le fait pour une personne de prendre en charge les intérêts patrimoniaux ou extrapatrimoniaux d'un tiers, sans son accord, donne en revanche lieu à une réponse pénale plus nuancée. Si le droit pénal manifeste parfois sa réticence face à cette forme d'immixtion, notamment lorsqu'elle touche à des domaines éminemment personnels, il ne s'y oppose pas de manière catégorique. Plus encore, il se montre, en certaines circonstances, bienveillant à son égard, soit qu'il l'ordonne, soit qu'il; l'encourage, lorsque l'intervention du tiers permet de sauvegarder des valeurs fondamentales, telles la vie et la dignite humaine. Témoin d'un droit pénal qui, bien que reconnaissant l'autonomie individuelle des personnes, demeure gouverné par l'intérêt général, son attitude rend compte de l'existence d'un ordre public de protection qui vient brider les aspirations contemporaines à une autonomie exaltée des personnes.
