This legislation provide a mechanism for members of professional groups to limit their liability for professional negligence. This paper documents and records the rationale and genesis of thos legislative initiative. In examining and commenting upon the first applications by professional organizations to bring their respective members under the protective umbrella of this legislation, this paper also considers its future significance for professional practice. Although the perspective is Australian, it will be relevant and of interest to professionals in practice in other jurisdictions where there are similar concern to maintain and preserve strict professional and ethical standards of practice.
