Civil libertarians characterize prostitution as a "victimless crime," and argue that it ought to be legalized. Feminist critics counter that prostitution is not victimless, since it harms the people who do it. Civil libertarians respond that most women freely choose to do this work, and that it is paternalistic for the government to limit a person's liberty for her own good. In this book Peter de Marneffe argues that although most prostitution is voluntary, paternalistic prostitution laws in some form are nonetheless morally justifiable. If prostitution is commonly harmful in the way that feminist critics maintain, then this argument for prostitution laws is not objectionably moralistic and some prostitution laws violate no one's rights. Paternalistic prostitution laws in some form are therefore consistent with the fundamental principles of contemporary liberalism.

"Starting in the latter part of the 20th century, the law of sexual offenses, especially in the West, began to reflect a striking divergence. On the one hand, the law became significantly more punitive in its approach to sexual conduct that is nonconsensual or unwanted, as evidenced by a major expansion in the definition of rape and sexual assault, and the creation of new offenses like sex trafficking, child grooming, revenge porn, and female genital mutilation. On the other hand, it became markedly more permissive in how it dealt with conduct that is consensual, a trend that can be seen, for example, in the legalization or decriminalization of sodomy, adultery, and adult pornography. This book explores the conceptual and normative implications of this divergence. In doing so, it assumes that the proper role of the criminal law in a liberal state is to protect individuals in their right not to be subjected to sexual contact against their will, while also safeguarding their right to engage in (private consensual) sexual conduct in which they do wish to participate. Although consistent in the abstract, these dual aims frequently come into conflict in practice. The book develops a framework for harmonization in the context of a wide range of nonconsensual, consensual, and aconsensual sexual offenses (hence, the "unified" nature of the theory) -- including rape-as-unconsented-to-sex, rape-by-deceit, rape-by-coercion, rape of a person who lacks capacity to consent, statutory rape, abuse of position, sexual harassment, voyeurism, indecent exposure, incest, sadomasochistic assault, prostitution, bestiality, and necrophilia"--

Summary: The objective of the proposed study is to analyze whether prostitution is inherently coercive and exploitative. The ontological question is this: what does exploitative mean to each framework, and which definition corresponds the best to reality? Further, how do these theories answer the question of whether prostitutes consent or are coerced into this position in society?In this study, I assess the nature of prostitution through Feminist, Marxist, and Liberal theories. -- Abstract. I will argue that a Feminist-Marxist framework is the best approach to understanding prostitution, and that subsequently decriminalizing the seller and criminalizing the buyer is the most effective policy. I will begin with an outline of each ontological framework, including the essential literature in understanding each interpretation of what it means to consent, and how it defines exploitation. Next I will identify the implications... Afterwards, I will analyze my own contention about which ontological framework best explains the nature of prostitution. Prostitution, Harm and Gender Inequality brings together international research exploring the range of gendered harms to women involved in prostitution and the consequences of growth of the sex industry for global gender relations. While there is an increasing amount of research and academic output on prostitution, the current focus is often on discussion and critique of policy frameworks, and contemporary debates over harm are largely limited to sex trafficking and sexual exploitation of children. Less attention is paid to questions of how the sex industry perpetuates notions of objectification and male entitlement with respect to sexual access to women's bodies, despite being key feminist concerns for several decades. This position has become effectively marginalized, but the global growth and industrialization of the sex industry requires a return to these questions. Through exploring gendered inequality and re-engaging with an understanding of prostitution as harmful with impacts on the self and body that are experienced as abusive but do not always constitute violence, this book introduces a range of research and thinking, while also drawing on existing literature to explore the consequences of prostitution for women in the sex industry and wider gender relations. These issues are discussed with regard to: coercion and recruitment, including trafficking; notions of male entitlement in accounts of men who buy sex; critical interrogations of agency and choice; legal and policy frameworks; and representations of prostitution in popular culture.
