This collection of essays assesses the efforts of African governments to constitutionalise decentralisation, be it in the form of federalism, local government or traditional authorities. Since the end of the Cold War jurisdictions across Africa have witnessed an ostensible return to multi-party democracy within the paradigm of constitutionalism and the rule of law. Linked to the democratisation process, many countries took steps to decentralize power by departing from the heavily centralized systems inherited from colonial regimes. The centralization of power, typically characterized by the personalization and concentration of power in the hands of leaders and privileged elites in capital cities, mostly resulted in repressive regimes and fragile states. As decentralisation is a response to these challenges, this volume analyses the dynamic relationship between the efforts to implement decentralization and presence or absence of constitutionalism. This volume examines a variety of forms and degrees of decentralization found across Africa. It advances a new understanding of trends and patterns and facilitates the exchange of ideas among African governments and scholars about the critical role that decentralisation may play in democratization of and constitutionalism in Africa.

The Great Lakes region of Africa is characterized by protest politics, partial democratization, political illegitimacy and unstable economic growth. Many of the countries that are members of the International Conference on the Great Lakes Region (ICGLR) which are: Burundi, Angola, Central African Republic, Democratic Republic of the Congo, Republic of the Congo, Kenya, Uganda, Rwanda, Sudan, South Sudan, Tanzania, and Zambia, have experienced political violence and bloodshed at one time or another. While a few states have been advancing electoral democracy, environmental protection and peaceful state building, the overall intensity of violence in the region has led to civil wars, invasion, genocide, dictatorships, political instability, and underdevelopment. Efforts to establish sustainable peace, meaningful socio-economic development and participatory democracy have not been quite successful. Using various methodologies and paradigms, this book interrogates the complexity of the causes of these conflicts; and examines their impact and implications for socio-economic development of the region. The non-consensual actions related to these conflicts and imperatives of power struggles supported by the agents of ‘savage’ capitalism have paralysed efforts toward progress. Rwanda's Gacaca courts provide an innovative response to the genocide of 1994. Incorporating elements of both African dispute resolution and of Western-style criminal courts, Gacaca courts are in line with recent trends to revive traditional grassroots mechanisms as a way of addressing a violent past. Having been devised as a holistic approach to prosecution and punishment as well as to healing and repairing, they also reflect the increasing importance of victim participation in international criminal justice. This book critically examines the Gacaca courts' achievements as a mechanism of criminal justice and as a tool for healing, repairing, and reconciling the shattered communities. Having prosecuted over one million people suspected of crimes during the 1994 genocide, the courts have been both praised for their efficiency and condemned for their lack of due process. Drawing upon extensive observations of trial proceedings, this book is the first to provide a detailed analysis of the Gacaca legislation and its practical implementation. It discusses the Gacaca courts within the framework of transitional and international criminal justice and argues that, despite the trend towards local, tailor-made solutions to the challenges of political transition, there is a common set of principles to be respected in addressing the past. Evaluating the Gacaca courts against the backdrop of existing or emerging principles, such as the duties to investigate and prosecute, and the right to the truth, the book provides a sophisticated critique of Rwanda's reconciliation policy. In doing so, it contributes to the development and the clarification of these principles. It concludes that Gacaca courts have achieved a great deal in stimulating a basic discourse on the genocide, but they have also contributed to assigning collective responsibility and may thus end up deepening the divides within Rwandan society.

Inspired by the ongoing process of decentralization and in an effort to inform local and national policy makers concerned with food security, this paper provides a descriptive but detailed geographical overview of Congo’s food markets as well as the nutritional status of its population. To do so, this paper will mainly rely on the 1-2-3 budget survey data, conducted in 2004–2005. Along both dimensions, access to food and nutrition, a good deal of spatial variation exists. First, overall efficiency of domestic food markets seems extremely poor. The capital city of Kinshasa is a good example of this; it is food deficient and poorly connected to its own hinterland and therefore highly dependent on foreign food imports. Markets in the former provinces of Kasaï, in the center of the country, and the conflict-prone northeastern part of the country are two minor exceptions, as food prices are slightly more equal. Furthermore, the most competitive food producers are found in Équateur and North Kivu. Notwithstanding these differences in food access, about five diet types can be identified. The most energy-rich diet is based on cassava and palm oil, typically consumed in Maniema, Orientale, Équateur, and rural Bas-Congo. As a result, these provinces on average display higher calorie intakes. Apart from diet composition, income levels and prevailing nonfood needs also determine energy sufficiency. For these reasons households in Katanga and North Kivu are relatively well nourished too, while urban dwellers in Bas-Congo and Orientale (contrary to their corresponding rural sector), and especially households in South Kivu and Kinshasa, suffer from large calorie deficiencies.

In the wake of the recognition of the Whanganui River in New Zealand, the Ganges and Yamuna Rivers in India, the Yarra River in Australia and the Atrato River in Colombia as «subjects of rights», the International Observatory on Nature’s Rights has initiated a reflection on the possibility of recognizing the St. Lawrence River, the «path that walks» as it is called by the First Nations, as a «legal person». The texts in this collective work deal with the implications of attributing a legal personhood and rights to the St. Lawrence River, delve into the epistemological foundations of the paradigm of the recognition of the rights of Nature and present concrete cases of recognition of rivers as subjects of law.
