Eu égard à l'existence d'autres droits fondamentaux et intérêts publics, il est aisé de convenir que la liberté d'expression ne peut s'exercer sans limite. Il s'agit toutefois de parvenir à un juste équilibre entre la liberté d'expression et les autres droits fondamentaux ou intérêts publics qui peuvent s'opposer à un libre exercice. Cet équilibre est, par essence, fragile et il peut revenir au juge de le rompre, suivant les circonstances, soit au profit de la liberté d'expression, ou au bénéfice des autres droits fondamentaux ou intérêts publics. Toutefois, à cet égard, la tradition juridique américaine est souvent décriée comme faisant triompher une conception absolue de la liberté d'expression. En comparaison, les approches européennes se caractériseraient par une plus grande pondération dans la recherche d'un équilibre entre les normes antagonistes. Afin de mesurer le degré de protection offert à la liberté d'expression, aux Etats-Unis et en Europe, et de s'interroger sur les limites qu'il convient de donner à une telle liberté dans une société démocratique contemporaine, les principes généraux réglant la limitation de la liberté d'expression seront, tout d'abord, examinés. L'étude de ces principes généraux permettra d'appréhender les différences ou les analogies qui seront découvertes dans l'examen de la réalisation, par le juge, d'un équilibre entre la liberté d'expression et les autres droits ou intérêts qui peuvent entrer en conflit avec celle-ci. Une fois connue l'étendue du domaine ouvert au libre exercice de la liberté d'expression, il sera alors permis d'énoncer les paramètres qui, au-delà de chaque cas d'espèce, paraissent décisifs dans la détermination des limites de cette liberté dans une société démocratique.

After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.
