La règle de droit ne semble pas être en cause, mais l'utilisation par le passé de traités imposés pour créer des obligations à la charge d'états non parties a un accord ou n'ayant pas expressément consentis aux prescriptions d'un acte unilatéral, a profondément freiné la tentative de les codifier. Mais le malaise persiste, car paradoxalement, la notion, non codifiée dans le cadre du droit des traités, ne semble pas, au vu des travaux préparatoires, abandonnée, et on laisse à la coutume le soin de régler ce type de problèmes.
