Les standards juridiques sont bien présents dans le droit français. Phénomène de mode ? Pas sûr car leur ancrage démontre leur intérêt. Le standard juridique procède fondamentalement d’une délégation du législateur. C’est bien la preuve qu’au delà de l’interprétation judiciaire de la règle légale, cette dernière n’est pas apte a réglementer seule tous les comportements : l’intervention complémentaire du juge est nécessaire. Le droit du travail connaît depuis longtemps ce mécanisme avec la cause réelle et sérieuse. Mais voila que depuis quelques années au gré d’apports jurisprudentiels et législatifs, une notion fondamentale s’est imposée : l’intérêt de l’entreprise. Consacrer une étude à l’intérêt de l’entreprise en droit du travail français était toutefois devenue nécessaire, voire urgent. La notion peut en effet inquiéter. Inspirant d’emblée plus un sentiment qu’une définition précise, façonnée par le juge, la notion d’intérêt de l’entreprise peut être source d’insécurité juridique. Cette recherche a pour but d’éclairer, de mette à nu le concept étudié, proposer une définition pertinente de la notion d’intérêt de l’entreprise, expliquer l’originalité de cette dernière par rapport à des notions concurrentes et plaider un nouveau contrôle de la notion sans oublier les illustrations pratiques qui confortent l’intérêt de propositions formulées. Dans une perspective plus fondamentale, nous entendons enrichir la réflexion sur la règle de droit, le rôle du juge et prouver, si certains en doutaient encore, l’apport des réflexions en droit du travail à une théorie générale du droit.

Globalization has led to growing labour fragmentation and widening of gaps in social protection. Although the enterprise is increasingly expected to be socially responsible, in actuality extreme worker inequalities and social dumping have become ubiquitous worldwide. This volume – the first to focus attention on the ‘theory of the firm’ as it reveals itself in today’s world from a multidisciplinary perspective – underscores the necessity to rebuild a new scientifically controlled paradigm that acknowledges and regulates the dimension of power in the functioning of the organization.
