Master and servant acts, the cornerstone of English employment law for more than four hundred years, gave largely unsupervised, inferior magistrates wide discretion over employment relations, including the power to whip, fine, and imprison men, women, and children for breach of private contracts with their employers. The English model was adopted, modified, and reinvented in more than a thousand colonial statutes and ordinances regulating the recruitment, retention, and discipline of workers in shops, mines, and factories; on farms, in forests, and on plantations; and at sea. This collection presents the first integrated comparative account of employment law, its enforcement, and its importance throughout the British Empire. Robert Travers' analysis of British conquests in late eighteenth-century India shows how new ideas were formulated about the construction of empire. After the British East India Company conquered the vast province of Bengal, Britons confronted the apparent anomaly of a European trading company acting as an Indian ruler. Responding to a prolonged crisis of imperial legitimacy, British officials in Bengal tried to build their authority on the basis of an 'ancient constitution', supposedly discovered among the remnants of the declining Mughal Empire. In the search for an indigenous constitution, British political concepts were redeployed and redefined on the Indian frontier of empire, while stereotypes about 'oriental despotism' were challenged by the encounter with sophisticated Indian state forms. According to the traditional understanding of American constitutional law, the Revolution produced a new conception of the constitution as a set of restrictions on the power of the state rather than a mere description of governmental roles. Daniel J. Hulsebosch complicates this viewpoint by arguing that American ideas of constitutions were based on British ones and that, in New York, those ideas evolved over the long eighteenth century as New York moved from the periphery of the British Atlantic empire to the center of a new continental empire. Hulsebosch explains how colonists and administrators reconfigured British legal sources to suit their needs in an expanding empire. In this story, familiar characters such as Alexander Hamilton and James Kent appear in a new light as among the nation's most important framers, and forgotten loyalists such as Superintendent of Indian Affairs Sir William Johnson and lawyer William Smith Jr. are rightly returned to places of prominence.
