Depuis quelques années, la " sécurité juridique " est très présente dans le discours doctrinal, influencé par le droit communautaire et la CEDH. Plus récemment, le Conseil d'Etat l'a consacrée sous forme de PGD. Malgré cette reconnaissance, l'identification de la notion et de ses implications en droit interne reste incertaine. C'est pourquoi il convient de (re)construire l'exigence à partir du droit positif, et notamment de la fonction de structuration du droit de la sécurité juridique. De fait, celle-ci permet d'expliquer comment le droit s'inscrit dans le temps, en cherchant à pérenniser les situations passées pour assurer sa stabilité et à anticiper sa réalisation dans l'avenir pour demeurer prévisible. Elle justifie aussi la manière dont est construit l'espace juridique, de manière à préserver l'unité et la cohérence du droit, et l'égalité de ses destinataires. L'impact de la sécurité juridique sur le droit interne est donc bien réel. Pourtant, ces structures ne lui permettent pas toujours de parfaitement se concrétiser. Ce constat révèle une dimension plus surprenante de la sécurité juridique, devenue principe de transformation du droit. Elle invite alors à procéder à de multiples mutations juridiques, pour une meilleure prise en compte de sa dimension individuelle. La sécurité juridique se trouve ainsi au fondement d'un renouvellement des processus normatifs devant permettre aux citoyens de mieux protéger leurs intérêts. Dans cette même logique, elle justifie aussi une " subjectivation du droit. Pour autant, la sécurité juridique ne s'incarne pas elle-même en un principe subjectif, ce qui pose la question de l'opportunité de sa transformation en un moyen contentieux, et finalement de l'importation du principe européen.
