We are on the threshold of a long period of construe tive readjustment and restatement of our law in almost every depart ment. We come to the task, as a profession, almost wholly untrained in the technic of legal analysis and legal science in general. Neither we. Nor any community, could expect anything but crude results without thorough preparation. Many teachers, and scores of students and practitioners, must first have become thoroughly familiar with the world's methods of juristic thought. Excerpt from Introduction to American Law But I have entitled this book, an Introduction to American Law, and I may be called upon to vindicate the propriety of this title. I confess then, that in some minor respects, it may not be equally adapted to all parts of the Union; but my excuse is, that without being ten times as large as it is, 'it could not have been made so. If I had possessed the knowledge, I could not, within any reasonable compass, have referred to the local law of twenty-six different states; and yet local references were occasionally necessary, in order to exhibit an entire system. I was compelled, therefore, in such cases, to make choice of some particular state; and I naturally selected that state in which the lectures were read. But these local references, in an out line so general as this, are not so frequent as to detract materially from the general adaptation of the book, to students in other states; and in case of diversity, the necessary corrections can be easily made. At all events, the diversity is less between the different states, than between any one state and England; and therefore something is cer tainly gained even on the score of general adaptation. And here let me anticipate an objection of another sort. It may be said, that in attempting to teach what the law is, I have dwelt too much upon what I think it should be; or, in other words, that in a work professedly didactic, I have speculated too much upon projects of reform. To this objection I have two answers. In the first place, I have never undertaken to show what the law ought to be, without first stating what it is. While therefore the primary end of instruo tion is obtained, the mind of the student is at the same time excited to compare, examine and discuss the principles in question; and thus impress them the more deeply upon his memory. And in the second place, if the suggestions I have ventured to make be sound, they can not be made too early, because bad laws are the very worst of bad things; and if these suggestions be not sound, they can do no harm, because the antidote accompanies the bane; nay the provision com plained of will inspire increased confidence in the mind of the student from having been unsuccessfully assailed. Excerpt from The Distinctions and Anomalies, Arising Out of the Equitable Doctrine of the Legal Estate The endeavour at the same time made to deal with the matter upon principle, and more especially to find an intel ligible basis for the doctrines of the priority of the legal estate and tacking, may also be of some practical utility. The ascertainment of principles is of importance as well to the study of the law, as to its successful amendment1 and judicial development. If the explanation of tacking here advanced be the true one, it will appear that there has been in recent times a tendency of the courts to extend in more than one direction that justly reprobated doctrine, which, however, ao cording to the accepted judicial axiom is to be applied only within the bare limits of the old authorities which established it. But if the theories put forward should prove upon further investigation not to be sustainable, they may perhaps claim the merit appertaining to hypotheses in general, that they are necessary steps to something more certain. Perhaps too the statement as a whole of equitable doctrine concerning the legal estate as it now stands - its intricacy, its fortuitous results, its occasional injustice, its technicality and immaturities - may help to make more clear the urgency of the case for the legislative reform of English property law. Excerpt from An Illustrated Treatise on the Law of Evidence To the trial lawyer no subject in the law curriculum is of more importance than Evidence. In this branch of the law questions arise very frequently, and usually they must be answered on the spur of the moment. It is essential, therefore, that the lawyer have at his tongue's end the rules and their exceptions. Moreover, since the test of the keen lawyer is his ability to make fine legal discriminations, it is also essential that he possess a well disciplined mind in the art of applying them. In the present volume an attempt has been made to state pointedly and systematically these various rules and exceptions; and since the law is an applied science, numerous illustrations have been given to elucidate their application. Every topic is fully illustrated; every illustration is founded upon an actual case, and for each case the citation is given. With the view of securing compactness, these illustrations, instead of being scattered throughout the book, have been made a distinct part of it and placed after the text proper. This plan, it is believed, will meet with general approval. As an aid in developing ability to make fine legal discriminations the reader is earnestly advised to study carefully these illustrations and where practicable to do so to read the cases upon which they depend. In the preparation of this volume it has been the aim of the author to produce a text-book which will prove serviceable when used independently of any other work; but believing that it will also be found serviceable in connection with the study of Thayer's "Cases on Evidence" the general arrangement of topics in that work has been followed.
