A los pocos días de hacerse pública la sentencia del Tribunal Europeo de Derechos Humanos de 3 de noviembre de 2009 sobre los crucifijos en las escuelas públicas italianas, el actual presidente del Consejo de Estado, Francisco RUBIO LLORENTE, declaraba que «uno de los problemas más difíciles que tienen hoy día las sociedades europeas es determinar la relación entre política y religión y la presencia pública de las religiones». Esto resulta palmario, también, si contemplamos las distintas valoraciones -y reacciones- que en nuestra sociedad provoca el porte del velo islámico u otras manifestaciones de religiosidad en los lugares y ámbitos públicos, incluso asumidas por los mismos poderes públicos (por ejemplo, cuando incorporan festividades religiosas al calendario civil, o emplean nombres religiosos para designar sus espacios o engalanan sus calles con símbolos de este carácter). Este trabajo propone un orden jurídico para estas referencias religiosas -e ideológicas de cualquier sentido- en los espacios públicos. Y esta es su tesis de fondo: no cabe invocar el carácter aconfesional o neutro del Estado -o su laicidad, como suele hoy decirse- para imponer la irreligiosidad en lo público, con detrimento para un pluralismo que los poderes públicos deben preservar. Se entenderá, por tanto, que lo que aquí se trata interesa no solo a los operadores y teóricos del Derecho, sino también a los responsables públicos.

Esta obra analiza si la condición de servidor público genera mayores limitaciones al ejercicio de la libertad religiosa de los sujetos que ostentan esa responsabilidad, en comparación con los ciudadanos en general; y si esa limitación es superior, qué la justifica y hasta dónde llega. Se trata de un problema de investigación que exige un doble abordaje. El primen), desde una perspectiva objetiva sobre los deberes del Estado laico y del ciudadano que se incorpora en él en calidad de servidor público. El seguido. desde un enfoque subjetivo sobre la libertad religiosa corno un derecho del que ese mismo servidor es titulan. Al conjugar las dos ópticas se desarrolla una reflexión sobre los límites de los límites del derecho a la libertad religiosa. La hipótesis planteada indica que en el caso del servidor público se configura una especial limitación o restricción reforzada de su derecho a la libertad religiosa, por causa de la configuración de una razón suficiente y justificativa de un trato desigual. La razón suficiente se integra por dos factores que caracterizan al servidor palco: poseen por ser parte del Estado, un mayor poder político con respecto al resto de ciudadanos, y, por esa misma identidad con el Estado, poseer una sujeción intensa al deber de laicidad. Esos dos componentes sustentan una mayor restricción del derecho a la libertad religiosa del servidor público.

This book offers an in-depth analysis of a fundamental human freedom and a cornerstone of democracy: the Freedom of Religions or Beliefs (FoRB).
