Depuis le 27 Août 2006, la recherche clinique est régie en France par un nouveau cadre législatif et réglementaire entré en vigueur suite à la transposition en droit français de la directive européenne 2001/20/CE concernant la recherche biomédicale portant sur les médicaments. La France s’est donc dotée d’une loi relative à la politique de santé publique le 9 août 2004 suivie de nombreux arrêtés et décisions visant à encadrer la recherche clinique. Ce travail expose l’évolution de la réglementation régissant la recherche biomédicale sur le plan international et plus particulièrement en France sur ces cinquante dernières années. Il montre comment les obligations réglementaires de déclaration des évènements indésirables graves (EIG) ont été modifiées afin de renforcer la protection des personnes se prêtant à la recherche biomédicale et détaille les responsabilités des différents acteurs de la recherche biomédicale, ainsi que le rôle des autorités compétentes lors de la gestion de ces évènements. Enfin, une étude de morbimortalité cardiovasculaire présente une application pratique de l’importance de la gestion des EIG.

That is why our understanding of appropriate and effective regulation of medical devices is significant to all people on all continents.
