Aunque la maternidad sea uno de los hechos biológicos más importantes en la vida de la mujer, desde su incorporación al mercado de trabajo compaginar ambas situaciones no ha sido siempre fácil. Es evidente que los riesgos capaces de afectar a la mujer trabajadora en su lugar de trabajo pueden multiplicarse cuando esta se encuentra embarazada o durante la lactancia; además de que estos riesgos, debido a los propios cambios sufridos por la mujer durante este período, en ocasiones se verán potenciados. A ello se añade que el embrión o feto puede verse dañado. Sin perjuicio de las precedentes, la Directiva 92/85/CEE para la protección de las trabajadoras embarazadas fue el punto de partida clave para que se elaborara una normativa específica de protección de la maternidad en el ordenamiento jurídico español. Este estableció la protección de la maternidad de las trabajadoras en la Ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales, cuya versión primera incurría en un evidente déficit de transposición de la norma comunitaria que ha sido salvado a través de los reglamentos y modificaciones posteriores que se han ido sucediendo para ir ampliando y definiendo esta protección.
