Annoncée de longue date, la réforme (ou plutôt le " toilettage ") du 10 juin 1994 tente de renouveler un droit des procédures collectives incapable d'apporter des réponses satisfaisantes aux problèmes que pose la " faillite ". Si officiellement les objectifs initiaux de la loi de 1985 sont maintenus, dans les faits leur dynamique a été entièrement bouleversée. L'examen de la poursuite de l'activité contractuelle, moment crucial de la procédure sauf prononcé d'emblée de la liquidation judiciaire, démontre le paradoxe de la réforme. Non seulement celle-ci menace la poursuite d'activité, mais encore elle remet en cause le caractère collectif de la procédure en autorisant les initiatives individuelles de certains créanciers. En revanche la loi de 1994 confirme les effets radicaux produits par la " faillite " sur le droit des obligations. Le contrat, véritable bien, devient un instrument économique et s'émancipe de l'emprise de ceux qui lui ont donné naissance, induisant en cela une véritable recomposition de la théorie des contrats. Par-delà le traitement des difficultés des entreprises, la loi de 1994 pose également un réel problème de " légistique ". En effet, cette réforme parcellaire et partisane n'est que partiellement cohérente, tant avec les dispositions de la loi de 1985, qu'avec d'autres textes ayant vocation à s'appliquer dans le cadre des " faillites ". La loi nouvelle exprime les aléas d'un processus d'élaboration législatif en grande difficulté.

Que faut-il entendre par influence ? Faute d'une définition juridique, il peut être recouru aux dictionnaires non juridiques. D'après ceux-ci, le terme d'influence signifie l'action, généralement graduelle et continue, qu'exerce une personne, une chose, ou une situation sur une autre. Ce phénomène est l'objet de l'étude. Il est examiné, de manière délimitée, dans les rapports du droit des procédures collectives et du droit des contrats. Le sujet abordé est précisément celui de l'influence du droit des procédures collectives sur le droit des contrats. L'influence du droit des procédures collectives sur le droit des contrats s'exerce selon plusieurs modes. Suivant un mode concret, le droit des procédures collectives exerce une action généralement lente et continue sur le droit des contrats, produisant des modifications. En d'autres termes, le droit des contrats porte pour une part sur les règles, les concepts, les notions du droit des procédures collectives qu'il accueille. Sur un autre mode, celui abstrait, le droit des procédures collectives exerce une action généralement graduelle et imperceptible sur le droit des contrats, suscitant en celui-ci des mutations. L'on est en présence des changements, des mutations qui, dans le droit contractuel, sont dus au droit des procédures collectives. A ces deux modes d'influence du droit des procédures collectives sur le droit des contrats, il y a lieu d'adjoindre un troisième mode, le mode éventuel. A cet égard, sont explorés les règles, les concepts, les procédés, les raisonnements qui sont à l'état brut dans le droit des procédures collectives et qui pourraient être transposés, adaptés dans le droit contractuel.

How can architecture today be simultaneously relevant to its urban context and at the very forefront of design? For a decade or so, iconic architecture has been fuelled by the market economy and consumers' insatiable appetite for the novel and the different. The relentless speed and scale of urbanisation, with its ruptured, decentralised and fast-changing context, though, demands a rethink of the role of the designer and the function of architecture. This title of 2 confronts and questions the profession's and academia's current inability to confidently and comprehensively describe, conceptualise, theorise and ultimately project new ideas for architecture in relation to the city. In so doing, it provides a potent alternative for projective cities: Typological Urbanism. This pursues and develops the strategies of typological reasoning in order to re-engage architecture with the city in both a critical and speculative manner.
