La loi du 4 mars 2002, relative aux droits des malades et à la qualité du système de santé, consacre les droits des malades, en réaffirmant et en renforçant le droit d'information du patient : c'est l'accès direct au dossier médical. Cette loi, constituant assurément un tournant dans la relation entre professionnels de santé et patients, devraient permettre de moderniser et de faire progresser cet outil central de la pratique médicale qu'est le dossier médical et ce dans le but d'améliorer la qualité des soins. Même s'il est loin d'être évident que l'accès direct au dossier médical se traduise par une extension des recours contentieux, il semble que le nombre de demande d'accès devrait fortement s'accroître ces prochaines années comme le laisse entrevoir l'augmentation de 233 % entre 2002 et 2003 au CHU de Nantes. Face aux nouvelles contraintes que représentera, à terme, la tenue d'un futur dossier médical très élaboré, on voit mal comment échapper à l'informatisation.

La loi du 4 mars 2002 dite de « démocratie sanitaire » a consacré le droit à l’information des patients et permet un accès direct au dossier médical. La charge de la preuve d’information incombe en outre aux médecins. Ces derniers ont-ils intégré ces nouveaux impératifs légaux ? Pour en faire le constat, nous avons réalisé une enquête téléphonique auprès de 52 maîtres de stage de médecine générale. L’objectif est de voir si les médecins généralistes informent leurs patients selon les nouvelles obligations, comment ils le font et de quelle manière ils peuvent en apporter la preuve. Après analyse des résultats, nous constatons un hiatus entre ce que les médecins pensent faire, ce qui est fait et ce qui est nécessaire au patient, ainsi qu’entre la bonne connaissance de la loi et le niveau de preuve de l’information peu satisfaisant. Ceci nous amène donc à recommander de noter plus systématiquement dans un dossier restructuré certaines informations sensibles : annotations sur les ordonnances en cas de risques graves, non respect des conseils prodigués, notes dans le dossier des conseils téléphoniques et des actes réalisés en visites, informations transmises à un confrère. Le médecin doit également être épaulé par les autorités sanitaires en lui facilitant l’accès à des documents écrits pré-établis fonctionnels ainsi qu’à une formation indépendante. Il doit en outre éduquer le patient dans sa recherche autonome d’information, notamment via Internet. Les maîtres de stage s’ils sont sensibilisés à ce droit à l’information transmettront ainsi plus efficacement un savoir faire qui a pour finalité d’améliorer la sécurité des soins et de répondre au désir d’autonomie des patients tout en gardant une relation médecin/patient de qualité.
