"Children and youth with special health care needs (CYSHCN) are a diverse group of children defined, by the Department of Health and Human Services Maternal and Child Health Bureau, as 'children birth to age 21 who have or are at increased risk for a chronic physical, developmental, behavioral, or emotional condition and who also require health and related services of a type or amount beyond that required by children generally.' This can range chronic conditions such as asthma or diabetes, to developmental disabilities such as Down syndrome or autism, to medically complex health issues such as spina bifida or other congenital disorders, to children with behavioral or emotional conditions. When a parent requests a special education due process hearing, the school district and the parent are required to participate in a resolution session before the hearing unless the parent and school district agree in writing to waive the meeting or they agree to use the mediation process instead. A resolution session is a meeting, convened by the school district, between the parent(s) and the relevant member or members of the IEP Team who have specific knowledge about the facts identified in the parent's due process complaint. The purpose of the meeting is for the parent of the child to discuss the due process complaint, and the facts that form the basis of the due process complaint, so that the school district has the opportunity to resolve the dispute that is the basis for the due process complaint. When a school district requests a due process hearing, no resolution session is required.
