This comparative philosophy of law book aims at formulating a new analytical approach to the Islamic legal tradition based on ‘juridical categories’, a concept that facilitates comprehension and understanding of juridical phenomena. Building upon legal comparativism and legal pluralism, this project intends to avoid bias caused by universalizing Western categories when analyzing foreign juridical notions, which inevitably results in the miscomprehension of non-Western ideas and institutions. Unlike existing literature, this project will not focus on substantive comparisons between normative contents, but on the ‘juridical perspectives’ that helped to shape the Islamic and Western legal orders.The book focuses on the most relevant juridical questions regarding the Islamic and Western legal perspectives, such as the different visions regarding juridical spatiality, the role of human reason and the relationship between law, man and the divinity. ‘Ideologies need enemies to thrive, religion does not’. Using the Sahel as a source of five comparative case studies, this volume aims to engage in the painstaking task of disentangling Islam from the political ideologies that have issued from its theologies to fight for governmental power and the transformation of society. While these ideologies tap into sources of religious legitimacy, the author shows that they are fundamentally secular or temporal enterprises, defined by confrontation with other political ideologies–both progressive and liberal–within the arena of nation states. Their objectives are the same as these other ideologies, i.e., to harness political power for changing national societies, and they resort to various methods of persuasion, until they break down into violence. The two driving questions of the book are, whence come these ideologies, and why do they–sometimes–result in violence? Ideologies of Salafi radicalism are at work in the five countries of the Sahel region, Burkina Faso, Mali, Niger, (Northern) Nigeria and Senegal, but violence has broken out only in Mali and Northern Nigeria. Using a theoretical framework of ideological development and methods of historical analysis, Idrissa traces the emergence of Salafi radicalism in each of these countries as a spark ignited by the shock between concurrent processes of Islamization and colonization in the 1940s. However, while the spark eventually ignited a blaze in Mali and Nigeria, it has only led to milder political heat in Niger and Senegal and has had no burning effect at all in Burkina Faso. By meticulously examining the development of Salafi radicalism ideologies over time in connection with developments in national politics in each of the countries, Idrissa arrives at compelling conclusions about these divergent outcomes. Given the many similarities between the countries studied, these divergences show, in particular, that history, the behaviour of state leaders and national sociologies matter–against assumptions of ‘natural’ contradictions between religion (Islam) and secularism or democracy. This volume offers a new perspective in discussions on ideology, which remains–as is shown here–the independent variable of many key contemporary political processes, either hidden in plain sight or disguised in a religious garb.

The involvement of minorities in politics has been the subject of a considerable number of studies. However, these studies are rarely concerned with the views of Muslims on their participation in the political processes of non-Muslim societies. Several Western scholars have thought and still think that the world, from the perspective of Muslims, can be divided in accordance with the dichotomy of the classical Islamic Law that distinguishes between the "Territory of Islam" and the "Territoryof War". however, during the last decennia various Muslim scholars have tried to reinterpret the position of Muslims in non-Muslim societies in new religious terms by which this classification has been emended and corrected. In this book, four different views are distinguished: the pragmatic, idealistic or utopian, re-interpretative, and traditionalist views. It goes without saying that the practical implementaion of these views to a large degree depends upon the types of Muslim organizations and representative bodies in those societies, as well as their denominational and ethnical backgrounds. From an international comparative perspective it appears that, contrary to the situation in Australia, Muslims of most Western European states have been thus far unsuccessful in creating representative organizations at national levels. This is also illustrated by studies of Muslim organizations in Germany, Italy and the united Kingdom. Another important factor consists of the views of the younger generations of Muslim immigrants about the compatibility of their Islamic identiity and full participation in the non-Muslim, secular societies in which they are living. Research on this subject contained in the present book responds to this question in an affirmative way.

Islam and the Métropole is an exploration of the colonial policies of France regarding Islam and the effects they had on religion in the early days of Algerian independence. Following the colonization of Algeria in 1830, the French authorities adopted a manipulative policy regarding the philosophy and practice of Islam. This was based on nineteenth-century theories of progress elucidated by Saint-Simonian thought and the philosophy of Auguste Comte, which posited religion as a symbolic language that could be geared toward political ends in the name of «progress». The ensuing use of Islamic language and a simultaneous effort to depict traditional Islam as backward while using the language of «progress» to legitimate colonial repression created a complex dissonance that was reflected in the Muslim opposition to colonial rule. This dissonance continued in the early days of Algerian independence as the government sponsored its own idiosyncratic version of «Progressive Islam» as the religion of state. The contradictions underlying this vision of religion were never sufficiently resolved, resulting in the violent failure of the state's ideology.
