Au-delà des objectifs stratégiques que l'on peut poursuivre - que ce soit comme avocat devant une juridiction, comme représentant d'un Etat devant une organisation internationale ou face à une opinion publique, comme auteur en quête de reconnaissance, ou comme citoyen intéressé par le droit -, peut-on l'interpréter de manière convaincante et argumentée, à défaut d'être objective ? Telles sont les questions à l'origine de cet ouvrage qui, dans le cadre d'une approche critique, met l'accent sur la profonde ambivalence du droit international. Ce dernier apparaît en effet tiraillé entre la poursuite d'un idéal universaliste de justice et de paix, d'une part, et la nécessité de composer avec des rapports de force inscrits dans un contexte politique, de l'autre. Dans cette perspective, il serait vain de prétendre établir, et encore moins "découvrir", les (seules) interprétations "correctes" de règles juridiques comme le droit à l'autodétermination, le principe de non-intervention ou la prohibition du génocide, par exemple. On peut en revanche fournir un aperçu des principaux débats qui agitent la doctrine, mais aussi les Etats ou les autres acteurs de la scène internationale. Dans l'ouvrage, ces débats seront illustrés par des références empruntées à la culture populaire et, en particulier, au cinéma et à la musique. L'ambition de ce livre est de permettre à la lectrice ou au lecteur, sur la base de ces éléments, de se positionner en sélectionnant et en défendant les arguments qui lui semblent les plus convaincants, et de comprendre plus fondamentalement les termes juridiques et politiques de la controverse...

It is during this era, couched between classic European imperialism and a new form of US-led Western hegemony, that fundamental legal debates took place over a new international legal order for a decolonised world.
