This report calls on the Government to record overseas students under a classification that does not count against the overall limit on net migration in order to allow the UK to continue to expand its share of the overseas student market. The Committee notes the Government's desire to reduce net migration. However, there is a clear conflict between this policy and the desire to attract more overseas students to the UK. Moreover, the way in which the policy has been implemented and measured is clearly having a detrimental impact. At a time of such economic difficulty, it is vital that the Department for Business, Innovation and Skills demonstrates it has an active strategy to support the expansion of this important and lucrative market. The Committee argues that, for domestic policy purposes, overseas students should be recorded under a separate classification and not be counted against the overall limit on net migration, along similar lines to the United States. The Committee supports the Government's policy to remove bogus students and colleges from our Higher Education system. However, the way in which this policy is communicated must be handled carefully to ensure it does not give the impression that the UK no longer welcomes genuine students

International student migration makes a significant contribution to higher education in the United Kingdom, with Southern Africa, and Nigeria in particular, positioned joint sixth in the top ten of sending countries. Many of these student-migrants, in supplementing their finances to fund their studies in the United Kingdom, undertake employment. Temporary and/or part-time employment is integral to the student-migrant experience, despite the express purpose of their admission into the United Kingdom designated for study purposes and not work. This explicit object is reflected in restrictions affixed to international students’ employment rights whilst studying; they are generally restricted to a maximum of 20 hours of work per week during term time and proscribed from working full time or as independent contractors. Given the scant regard this topic has received in the existing literature, this study offers an examination of students’ lived employment experiences under these rules. The study aims to offer a contribution, first in respect of the employment experiences of student-migrants through the analytical framework of ‘precarity’ by examining the various manifestations of insecurity in the students’ lived realities, nuanced by structures of migration control and labour market temporalities. Secondly, by adopting the socio-legal schema of legal consciousness, the study considers the student-migrants’ relationship with the law by way of the legal restrictions on their employment and examines their agency as evidenced through efforts to derogate from these rules.

There is tension between the twin goals of ensuring a flow of high quality students into the UK and ensuring and maintaining public confidence in the immigration system. The Home Office, through the UK Border Agency, introduced Tier 4 of the Points Based System for student immigration in March 2009 to control the entry of students from outside the European Economic Area. The Agency, however, implemented the new system before proper controls were in place and removed the controls it relied on under the old system. The controls gap enabled a surge in student visas and, in 2009 an estimated 40,000 to 50,000 additional migrants came to the UK to work rather than study. The Agency has had to spend the subsequent three years amending rules and procedures in an effort to reduce abuse. This constant change has made it very difficult and costly for students and education institutions to keep up to date with the increasingly complex set of rules and guidance that has emerged. The Government expected that clamping down on abuse of student visas would play a part in reducing net migration. However the measurement of net migration is still based on inaccurate International Passenger Survey data. The e-Borders system for counting all migrants in and out of the UK will not be in place fully until 2015 at the earliest. It would also be more informative to also report net migration statistics excluding students, as a number of other comparable countries do

This report from the Science and Technology Committee finds an 'unwelcoming' UK has led to an unprecedented fall in international Science, Technology, Engineering and Maths (STEM) student numbers. International STEM student enrolments have fallen by more than 10% in the last two years. The Lords inquiry looked specifically at the numbers of international students in STEM subjects, and whether the UK's immigration policy has had any impact. The Committee calls on the Government to rethink their immigration policy, which it calls contradictory. The Government is simultaneously committed to reducing net migration and attracting increasing numbers of international students (15-20% over the next five years. Students, who comprise a majority of non-EU immigrants, should be removed from the net migration figures. International students make a huge contribution to the academic, intellectual and cultural vibrancy of UK universities, also enriching the experience for domestic students. International students also contribute very significantly to university finances, often partly subsidising courses for domestic students. Some courses, particularly taught Masters, are made viable by international student enrolments, and a fall in international student numbers poses a real threat. In terms of the labour market, UK Plc is missing out on highly skilled workers. The Government should review their package for international students every two years to ensure it is globally competitive and it should reinstate the previous post study work route, which was simple and effective. Welcoming and clear language should be used in information is provided to prospective students.
