What are the prospects and means of achieving development through a democratic politics of socio-economic rights? Starting from the position that socio-economic rights are as legally and normatively valid as civil and political rights, this anthology explores the politics of acquiring and transforming socio-economic rights in South Africa. The book brings together an interdisciplinary group of leading scholars in an examination of the multifaceted politics of social and economic policy-making, rights-based political struggles and socio-economic rights litigations. The post-apartheid South African experience shows that there is no guarantee that democracy will eliminate poverty or reduce social inequality, but also that democratic institutions and politics may provide important means for asserting interests and rights in regard to development. Thus it is argued that democratic politics of socio-economic rights may democratise development while also developing democracy.

Public discussion of global healthcare issues is dominated by those who believe that top-down, government-driven interventions are the solution to the myriad health problems suffered by people in less developed countries. This thinking is responsible for a plethora of harmful policies, ranging from a drive towards socialized healthcare systems, to calls for the centralization and semi-nationalization of pharmaceutical research and development, to impractical but grandiose UN-sponsored schemes for tackling HIV/AIDS and malaria.In spite of the abysmal track record of top-down approaches, non-governmental organizations and UN agencies continue to promote them, to the detriment of the private sector, economic development, and human health. The resulting politicization of diseases such as HIV/AIDS has led to a diversion of resources away from more easily treatable diseases that affect more people. Meanwhile, cost-effective and simple interventions such as vaccination are being subordinated to other more politically correct diseases.This centralizing mindset has also resulted in many governments in less developed countries attempting to plan and control universal healthcare systems, which has encouraged rationing, inequitable access, and entrenched corruption. It has also seriously undermined the effectiveness of overseas development aid. Moreover, the politicization of diseases such as HIV/AIDS has led to a diversion of resources away from more easily treatable diseases that affect more people. As a result, cost-effective and simple interventions are neglected by donors.There has to date been little public discussion of the role of markets and their underlying institutions--property rights and the rule of law--in improving human health. This book examines and analyzes issues related to public finance in subnational governments, along with a discussion of case studies on decentralization. Most of the analysis applies to all public goods and services provided by subnational governments, with some placed on the role of subnational governments in the management of environmental resources, notably water and waste Coverage includes optimal arrangements for sharing fiscal responsibilities among different levels of government, the potential impact of decentralization on the quality of public goods delivery, local governments’ expenditure and revenue choices, and the effect of decentralization on accountability, governance and policy outcomes. The scope of discussion extends to both public finance theory and applied policy debates. The first chapter, on trends in financing of public services, opens with an explanation of the how and why of government intervention in the economy, the nature and purposes of transfers between and among governments and trends in decentralization. Case studies examine the impact of decentralization in such areas as service delivery, water and sanitation, education and health, and on poverty and income inequality. Chapter 2 examines public budgets: governance structures, norms and organizational practices, building up understanding of budgets, budget cycles, fiscal revenues from fees and taxes, expenses, debt and political economy issues, rules mandating balanced budgets in government and more. Chapter 3 discusses issues of accountability and policy outcomes, offering important lessons from recent international experience, including ways to strengthen political, administrative and financial accountability. The concluding chapter recounts lessons from recent international experience and surveys implications for the nexus approach to management of environmental resources. South Africa has achieved a lot on its path of socio-economic transformation since the end of Apartheid in 1994. While many challenges remain to foster inclusive growth to address the triple challenges of unemployment, poverty, and inequality, some innovative approaches have been used to build more inclusive public institutions. These have helped to expand service delivery, strengthen quality, and improve the lives of millions of South Africans. Although much is known about the motivation and nature of the policies and institutional changes that drove this transformation, very little is known of the manner in which they were executed. With this book, Making It Happen, From Policies to Implementation, we offer a selection of twelve case studies to illustrate how policies and institutions were developed and implemented to improve specific public services. Done through interviews with senior policy makers, the book captures the how to of executing these policies in a variety of areas including increasing budget transparency, developing an intergovernmental fiscal system, strengthening tax administration, developing a modern performance monitoring and evaluation system, expanding HIV/AIDS treatment, reforming the social transfer system, strengthening statistics, creating a modern national identity system, developing a system for the management of biodiversity, modernizing the national road network management, developing the framework for renewable energy, and the formulation of the country’s much lauded constitution. Tracing a twenty year journey of transformation, this book places particular emphasis on recording the design of these reforms and endeavors to shed some light on the decision-making processes. In particular, it attempts to provide insight on the trade-offs policy makers faced, and the sequencing and complementarities among the various reforms.
