This examination of lobbying communities explores how interest group populations are constructed and how they influence politics and public policy. By examining how populations of interest groups are comprised, this work fills an important gap between existing theories of the origins of individual interest groups and studies of interest group influence. The population ecology model of interest communities developed here builds on insights first developed in population biology and later employed by organizational ecologists. The model's central premise is that it is the environmental forces confronting interest organizations that most directly shape the contours of interest populations. After examining the demography of interest organizations in the fifty American states, the population ecology model is used to account for variations in the density and diversity of their interest communities, the nature of competition among similar interest organizations to establish viable niches, and the impact of alternative configurations of interest communities on the legislative process and the policies it produces. These empirical findings suggest that the environment of interest communities is highly constraining, limiting their size, composition, and potential impact on politics. This book addresses the disparity between positive non-treaty law and its scholarly assessment in the area of moral concepts, understood as altruistic as opposed to reciprocal legal obligations. It shows how scholars are generously willing to assert the existence of a rule of international law, thereby moving further away from actual state practice, not taking into account the factors of legal rhetoric and the core survival interests of the state in the formation of custom and general principles of law. The main argument is that such moral concepts can simply not manifest themselves as non-treaty sources of international law from a dogmatic perspective. The reason is the inherent connection between the formation of the non-treaty sources of international law and state interest that makes it difficult, if not impossible, to assess state practice or opinio juris in the case of altruistic obligations. The book further demonstrates this finding by looking at two cases in point: Human rights and humanitarian exceptions to the prohibition of force. As opposed to the majority of existing works on the subject, State Interest and the Sources of International Law takes a bigger-picture approach to a number of distinct problems in international law scholarship by looking at the building blocks of international relations on the one hand, and merging this with sources doctrine on the other. It has become a commonplace assumption in modern political debate that white and rural working- and middle-class citizens in the United States who have been rallied by Republicans in the “culture wars” to vote Republican have been voting “against their interests.” But what, exactly, are these “interests” that these voters are supposed to have been voting against? It reveals a lot about the role of the notion of interest in political debate today to realize that these “interests” are taken for granted to be the narrowly self-regarding, primarily economic “interests” of the individual. A long-dominant reading of American politics holds that public policy in the United States is easily captured by special interest groups. Countering this view, Adam Sheingate traces the development of government intervention in agriculture from its nineteenth-century origins to contemporary struggles over farm subsidies. His considered conclusion is that American institutions have not given agricultural interest groups any particular advantages in the policy process, in part because opposing lobbies also enjoy access to policymakers. In fact, the high degree of conflict and pluralism maintained by American institutions made possible substantial retrenchment of the agricultural welfare state during the 1980s and 1990s. In Japan and France--two countries with markedly different institutional characters than the United States--powerful agricultural interests and a historically close relationship between farmers, bureaucrats, and politicians continue to preclude a roll-back of farm subsidies. This well-crafted study not only puts a new spin on agricultural policy, but also makes a strong case for the broader claim that the relatively decentralized American political system is actually less prone to capture and rule by subgovernments than the more centralized political systems found in France and Japan. Sheingate's historical, comparative approach also demonstrates, in a widely useful way, how past institutional developments shape current policies and options.

This book re-examines the law governing the obligations of the Member States in the European Union from the perspective of the interests formulated and pursued by national governments in the EU. Member States’ interests provide the source as well as the limitations of the obligations undertaken by the Member States in the Union. From the early days of European integration, they have determined how the law frames and defines EU obligations in the Treaties, in legislation and in the jurisprudence of the EU Court of Justice.
